hi all. this website is awesome. i'm unsure if this is the right place to post this. soon to be ex-wife just just left me a message saying i've been summoned by mann bracken to go to court for a debt with target. i don't live there but she took the summons. is that legal? what do/can i do? unsure about the details, i have not seen the papers yet. any advise would be much appreciated. thanks all.


I can't resist THIS one ( sorry..). Why would your ex 'accept' a summons, that was for you? Was the summons in her name, too? The person that gave her the summons, and if the summons was ONLY in your name, shouldn't have given it to your ex. I would think you would have a 'leg to stand on' on THAT issue. However.......other people, on this forum, would know ALOT more than me, concerning this. Wanna tell ya alittle story. I live in the state of PA. I was at my ex-husband's home, with my son. My ex was not home. A Constible came to the door, with a Summons for my ex. BOTH my ex and I know this man ( have known him a long time), however, he he couldn't give me the summons because it was in my ex's name, ONLY.

thanks for the story. thats what i thought also. its only my name on the summons. i live in ca. i don't think the law is different. well, she told me that the summons doesn't even have a court date. it just says for me to go to the court and respond within 30 days. has anyone ever had to do this before? what does it mean? i plan on filing bankruptcy, but not until feb. when the divorce is final. i heard i should call and tell mann bracken i am filing for bankruptcy and they will drop the case and stop bothering me. is that true? whats the worst that can happen? any advise or stories would be helpful. thanks again.

Am i in the right thread. i didn't see any for being sued.

Contact the clerk in the county where the summons originated from to make sure the summons is real, if it is, notify the clerk that you weren't served properly. They could have purposely sent the summons to the wrong address hoping you wouldn't appear in court and get a judgement against you.

hey, ADTNSD...did you find anything out on your issue? I use to live in CA, too. I don't think it was legal for your ex (?) to do what she did.
