question about marshall's notice

I own a retail store and owe money to a distributor. I was unable to pay them due to the recession. They sent me a summons to appear in Civil Court. I worked out a payment plan with them and we never went to court. I fell behind on the payments again and this time I received a marshall's notice stating that unless I pay the amount owed immediately they will physically levy my personal property. They also asked that a money order or certified check be made out to to the marshall. Can they just come to my store and take whatever I have inside? Can they close my store? I'm trying so hard to keep my doors open so I can pay my debts but they make it impopssible to do so.


I think you should check the court to make sure they did not go to court anyway after you setup a payment plan. A Marshall can come physically take property in certain situations but only after a person has won a civil judgment against you. I would check with the courthouse then come back here so we can offer any possible advice.
