collection agency calling ex-husband

I had a collection agency call my ex-husband's cell in regards to past medical bill. It is close to the end of the statute of limitations to end. This individual told my ex-husband all about my debt, how I had stopped payment on the check, how much I owed them and the NSF charge of $25.00.

I talked to them two months ago and asked for verfication of the debt and received nothing. My doctor's practice filed for bk protection around this time of the supposed debt. Does this mean that his collection agency bought this debt and is trying to make money on this debt or what. Did they violated the FDCPA for telling my ex-husband everything about this debt.

I am on SSDI because of MS so they can't garnish my wages or do anything to me as far as getting money out of me. I just need to know if what this guy did was legal or not.


I don't think it is legal for a collection agency to call your ex-husband for the debts you owe. Although they cannot garnish your ss income, they can definitely bring judgment against you to garnish your bank account even if you are on ss income. This judgment will also affect your credit score.

It would be a challenge to prove in court that they acted in bad faith. 1) The debt is old so I am guessing you were married when the debt occurred. And 2) unless he has evidence that he specifically told them that he is no longer married to you (or you specifically told them), it would be near impossible to prove as a violation. If you told them (*especially* if you wrote a letter and have a copy of it) then yes - it is a violation.
