Cease and Desist Letter

Does the Cease and Desist letter work for a debt that is over 5 years old. Does it work to say you only want to deal with the original creditor. I have a $189 debt to Advance America from maybe 6 yrs ago. Pargon Way owns it now. Paragon sent JCC Christensen after me. JCC offer a settlement of $90.86. I send the money in in the alloted time frame. Before they recieved the payment Paragon took the debt from JCC and gave it to Merchant Bank. I would like to pay this but I am afraid to deal with the collection agencies. What are the chances of Advance America settling with me?

You have already sent in the money? Did they send it back to you or do you have to basically have to start all over again. I think a C&D letter works for any time frame, as long as it is being sent to a third party collector. If you have it in writing from JCC that they were willing to accept the settlement then maybe Merchant bank will be willing to accept the same settlement. I'm not sure of your chances of dealing with Advance America, since they have sold the debt, but they may be willing to accept it back with a settlement negotiation.
