Complaint filed in court by Midland funding llc
Date: Wed, 12/15/2010 - 15:25
I am in the state of ohio and any help input on this would be greatly appreciated. The letter I received from the court contains the following:
"you have been named defendant in a complaint filed in *** municipal court by Midland funding llc
A copy of the complaint is attatched. The name and address of the Plaintiff's attorney is *** . You are hereby summoned and required to serve upon the plaintiff's Attorney a copy of an answer to the complaint within 28 days after the service of this summons on you, exclusive of the day of service. Your answer must be filed with the court within 3 days after the service of a copy of the answer on the plaintiff's attorney" (I gathered from reading other posts there is some form I go to the court and fill out? Is this the "answer"?) "If you fail to appear (appear where? at the attorney's office?) and defend, judgement by default will be rendered against you for the relief demanded in the complaint"
The complaint is for a credit card I defaulted on for $5989.58, which the bank charged off june 11th 2008. According to the paperwork the SOL is not until 2013, so what are my best options here? I don't think I should contact the attorney and try to settle, because couldn't that be seen as an admission of guilt? Also should I fight this, and how do I file this answer they expect, and what needs to be included? I don't have much money and don't own anything substantial, so I don't know what they could hope to gain by winning. Also I know I'd probably be better off getting an attorney, but I'm not sure I could afford one. Like I said any help at all would be greatly appreciated, I got the letter today, so I still have time, but would like to clear it up as soon as I can!
