ok, so I got a phone call from midland credit management, the guy says "I am calling about the letter we sent you last week..." Well, I didnt get any letter last week, so he told me he would send out a duplicate. The "duplicate" came, and contained no disclosure of consumer rights, etc etc etc, it was basically just a demand for payment.
So, I call him back and inform him that we dispute the debt, and that the last two CA's that had this same debt gave it up because they could not provide proper legal validation. One DV letter later, and I didnt hear from them for a while, about a month. Then, I get these settlement offer letters in the mail, they keep coming. And another letter shows up a couple weeks back-it says something like this:
"We have received your notice of dispute and are conducting our investigation into the matter. In the interest of resolving this matter as quickly as possible, we are requesting that you forward any relevant documentation you have concerning this account. Please send any cancelled checks, payment receipts, and documentation concerning this matter to (fax number)."
OK, so I have no knowledge of this account at all, have repeatedly told them this, and then they have the stones to ask me to provide THEM validation of the debt? What a crock....even if this debt were mine, who would send them such documentation?
OK, so now, I call them. (press record, of course!). I ask the guy how stupid he thinks I am, right out of the gate. So, he tries to claim that I dont have the right to request validation or to dispute it anymore because they gave me 45 days and I waited too long. Its a real shame for them that I have every telephone call recorded, including the call where this exact same guy informed me of the date they purchased the account, and that combined with their letters and mine simply buries them on this one. So then, the guy's like "let me transfer you to my supervisor, he is a "dispute resolution officer"....
the new guy gets on the phone, and he didnt even care that the call was being recorded, he was like "hey, the law is what the law is, and if you proceed with legal action, we will simply bury you in the courtroom. Is your car paid for? We're gonna go after that, and then you wont even have a way to get to work, how do you like that! how about your house? I think we'll push for a creditor lein on your house too....."
Could these guys be any more full of it?? keep in mind, they are claiming that we owe something like $500 on this debt....but he's gonna take my house and car?? What kind of moron does it take to be a "dispute resolution officer"??
