Midland Credit shows up on my credit report out of nowhere!

I received a letter from MCM saying I owed them $6,143.08. I sent a validation letter asking for validation of the debt, proof they were licensed to collect in my state, proof they owned the debt and media to back-up the amount they claim I owe. All I got from them was a photo copy of where the vehicle was sold at auction (this stems from a reposession in 2004) and a photo copy of the 'vehicle condition report' that was filled out when the vehicle was picked up. They didn't provide me with any information I requested at all! What should my next step be??

Record their phone calls (if your state law permits) document their calls, save letters. You will be able to use all of this to mount a case against them if you would like to file suit against them.

I would send them another certified letter telling them that they have not met the requirements for validation as set forth by federal law, and that they will be in direct violation of that law if they proceed with any further collection activity. Let them know that you know the law, so that they will understand that they cant just break it at will in your case. If nothing else, you will be able to show a judge the attempts you made to get to the bottom of this debt, and it will also show the judge that they failed to follow the law.
