midland suing me

i have filed bankrupcy back in 2000, i though i can't get sued for the lap time it's over 11 years? and the account is closed? but found out that capital one employee sold are info over the internet got a e-mail from capital one saying my account has been given out. now it's active and some one must using the account now midland is suing me for 9000 plus court cost and attorny cost.....


Hang on, you declared bankruptcy....was this debt a part of that bankruptcy? If you included this debt in the BK and the BK was discharged, then it doesnt matter how much time has gone by, the account is dead and they have no legal right to sue or collect ever again.

If you have documentation from cap one that the account info was sent to someone else, then you definitely have sufficient proof that you have not done anything wrong. Gather your BK paperwork and make sure that this account was included in that BK.
