Can anyone give me any advice? I have a court ordered payment agreement with the law office of Howard Lee Schiff, and just because I have not made my November payment as of today, November 26,. they have put a warrant out for my arrest. I have tried calling them 4 times today to make the payment and I can't get through and now they are closed for the evening. I am going to make my payment first thing Monday morning, and hopefully if I do that I will not have to go to court in December. There were also 2 payments I missed over the summer, but I can make those up on Wednesday. I had to call the sheriff's office and he scheduled a court date for me. Can someone tell me, will I be OK if I make the payment on Monday and if I make up the 2 past payments will I still have to go to court? They treat good people like criminals, My lawyer says there is nothing he can do and he doesn't think it's worth it for him to go to court with me. I read on this thing that if you bring a lawyer they won't even show up. He also says it's legal for them to buy old debts and do this to people. Is that true? Is there anything unethical or shady or illegal about what they are doing, and can I take any legal action against them? Please advise.


I think that once you make the required payments, you'll not have to go the court anymore. However, make sure you keep the payment receipts. This is because, even if you have to appear in the court, you can at least show the payment receipts to the judges. I feel it is better to consult another lawyer and take a second opinion. May be he will be able to help you out.

It is not illegal to buy old debts and try to collect what is owed. However, it is illegal for a collection agency to report a debt on your credit report that has passed the Statute Of limitations period. They even can't sue you for the non repayment of a debt that has passed the Statute Of limitations period in your state.
