I received a summons for an old benficial loan i had tried to pay off but never could seem to quite get past the extremely high interest (i was young and stupid i got a check for 2 grand from them in the mail and cashed it not understanding what it really was.) i received the loan in pennsylvania i have lived my whole life in pennsylvania but i currently work in new york state and was served the summons in new york state at my place of work and its the work address they have listed as my residence... well in ny the SOL would still be in effect it is 6 years on a promissary note but in pa where i have always actually live it is 4 years and according to the date of the owed amount on THEIR complaint form it was 7/31/2004 in the state of my residence it is out of SOL but they are suing me in the state of ny where it would still be valid can anyone advise me on what to do?

Thank you so much SOAPLADY :)

I had called their attourneys office and explained to them that i have never resided in ny but she said well you can be served anywhere that doesnt matter and i said well true but the simple fact remains im not a resident of the state and never have been so the state of ny couldnt possiably have juristiction in this matter and they said they would get back to me but have not done so. I also told them on the phone that their client had never been able to show proof this was my debt either. do i need anything to prove to the city clerk that i reside in pa other than my pa drivers license when i go down to respond in person?
