Midland Funding,LLC Need advice please

I thought that when I hit submit it went but guess not. I guess when it rains it pours as today in the mail I receive a letter from Mapother & Mapother, P.S.C. dated April 24, 2008. In it they state and I quote, " At this time, no attorney with this firm has personally reviewed the particular circumstances of your account but may consider remedies to recover the balance due if you fail to contact this office". It goes on to say that I have 30 days or receipt of the notice. By my calculations, my 30 days are up AFTER tomorrow. Am I correct? I have my validation letter ready to go (used the new and improved letter from the template)but is there anything else I should comment on? I will be sending this via certified mail return receipt. Should I call their office or wait for their response to the validation request? After reading what scum bags Midland Funding is I want to make sure that I am doing everything correct.

So I am guessing that you are in either Kentucky, West Virginia, Southern Ohio or Southern Indiana?

Which state do you live in?

Are you familiar with the debt and if so, when was the last time you payed on it?

I can't honestly say about the letter. Look at the envelope and see when it was mailed. Also check the zip code to see where it was mailed from. There is no way it should take that long and seems overshadowing that they are purposely trying to violate you 30 day rights.

I am dealing with something similar, I am getting letters from an attorney in my state, same disclosure as you. I am getting phone calls from an attorney in NY. The letters where sent to me from a collection agency in Michigan.

I received a phone call last week, the message that was left was not clear. I think the caller said his name was Chris & he was from Midland funding llc & I was to call him back but he didn't leave a phone number. Please let me know if you have any info about this. Thanks

check out the statue of limitations on open accounts in your state. ohio is 4 to 6 years and then they cant collect on your old debt and according to ohio state law they cant collect if they are not the orginal creditor and then your creditor is only one you have to pay.

My niece has a judgement against her from Midland Funding through Mapother & Mapother. They have frozen her checking account and have a judgment against her to take 25% of her paycheck twice a month. She cannot afford the judgment. All she wants to know is who she owes this debt to and they are refusing to give her information. They won't even tell her how long they will be collecting. It seems to be open ended with no end in sight. All she wants is information! I keep asking her who she owes and she can only think of an old car debt where she bought a Pontiac but wrecked it in 2003. I have given her the phone number that was posted on this web site to start with. All she had was the number for Mapother & Mapother who refuse to give her any information, but only to call the bank, who told her they didn't know who she owed the debt to to call the company sueing her. This is crazy! Are we living in America???

Your guide helped get the suit against me dismissed. I went to court and just like you said the attorney on the other side asked me to speak in the hallway. He told me I was going to lose my case if I went back into the court to defend myself. He pulled out a settlement agreement and asked for my signature. He laughed at me when I said no. 5 minutes later, the judge not only dismissed my case, she commended me on my paperwork. Thank you!

VICTORY!

Appeared in court this morning for my hearing. The opposing attorney was there with about 9 other cases and mine. The judge instructed us to "go downstairs" to speak with the attorney to try to work it out. When my name was called, I expressed that the debt was not validated, and that I did not desire to speak with the attorney.

The judge said basically, "DO IT ANYWAY."

So, I went downstairs and stood in line waiting to speak with the attorney. When I got my turn, (he was very polite) and said, "So, you've received no information validating that this debt is yours?" I answered, "Not a thing." He fumbled through his file (it was very thin) and then said, "Well I don't have anything here that can validate it either. I am going to dismiss your case."

Fifteen minutes later we reappear before the judge, and the attorney voluntarily dismissed the case.

Fast and easy. I was amazed at how many people answered the original complaint and then failed to show for the hearing. Default judgments were awarded in all of those cases.

Your information guided me in the right direction, and my case was dismissed. I would have never known what to do or even where to go. I wanted a way to fight back and I found it. You are a good person for helping others, and I wish nothing but good things for you.
