What do I do Next?

I have two separate issues involving an old internet PDL (which I overpaid and is considered illegal in my state according to my AG) that TWO collection agencies are trying to collect on. And another question regarding debt verification in general. I am trying to everything by the book to keep these agencies off my back and keep my job. The first issue....

Ireceived a phone call on February 12th regarding a debt owed to Pay Day Loan-Yes. I sent a request for validation that day. I received an Account Verification Statement dated the April 13. I again sent a request for validation telling them what they sent me was not what I requested..I did this on April 29th. I received the same Account Verificaiton Statement dated June 1. What do I do now...is there another letter or do I just keep sending the same letters?? and how long does this go on.

In addition, I received a phone call on May 12th from another Collection Agency stating they were collecting on the same debt. I informed them that there was already a company trying to collect on this debt and I have been corresponding with them. The woman claimed they in fact owned the debt. I did not want to argue so I simply asked for their address and fax and sent a letter reqesting validation. They seemed to have given up as I have not received any phone calls or letters....but How may companies can collect on a debt at a time????

I more than likely could just quit writing letters, etc and there would be nothing these companies could do because our state will not allow leagal action or collection on internet pdls, however my company checks our financial records every two years and I want to have all my documentation in order in case I have to submit it.

Lastly, I received a letter from a CA (Mitchell N Kay) informing me they were collecting for an old credit card debt dated April 1. I thought I had paid this off throught my consolidation program so I sent them a request for debt validation on April 15. They responded in a letter dated April 24th that they were obtaining the information I requested and as soon as they have it, they will forward to me. How long do they have to provide me with the information? What do I do next?


as far as mitchell m kay goes.there is no timetable,but they cannot pursue further collections until they can validate.as far as payday loan yes.file AG complaints.if you already did.file more complaints.you owe them nothing.also file complaints against both bottomfeeders attempting to collect on it.

I have filed with my AG as well as with the FTC. I know they can not do anything to me and I paid them about 1200.00 on a 400.00 loan, so they can go suck wind as far as I am concerned. I just want to be able to document in case it comes up. I just get tired of the various CA phone calls. I think there were acutally three trying to collect at one time. There was one I did not talk to and blocked from calling me. The whole thing with Mitchell N Kay is worrysome. I know they are scum. I just want to make sure that I keep my ducks in a row with them because they are known to be bottom feeders who will take you to court and that would cost me my job. Am I wrong to think that it should not take them two months to get me this information?

Roxy- they may not be able to valudate on the Mitchell Kay thing, and that is why no reponse..When I first started the LVNV dance, they never validated. A few months later, I got a phone call,then letter from another of their companies trying to collect. I send them a debt validation letter, along with the first one. They didn't validate-passed it to another of their groups, and so on and so on--every time I received one, I sent a DV,along with the many copies of the others in their group I sent it to. Just be careful and document everything, keep copies,etc..good luck--let us know what happens..karen

Karen, I was thinking that is what is going on. I also think (and I need to get a more recent copy of my credit report) that the SOL has run out. But like I said, I am trying to do the right thing. About the same time I received my first letter from MNK, I was on here and there were several people who posted they were being contacted by MNK to collect on old credit card stuff...all from the same company. So it would not suprise me if they can not validate. On another note, of the 9 internet pdls I had...the only one who will not leave me alone is Pay Day Loan Yes....and it has been almost two years. I mean, I borrowed 400 and waay overpaid them back...they already made their money and then some....and they want another 680. UGH!
