Working with the original creditor??

I have an old account that was sent to Mitchell N Kay. I believe this to be past the sol (I am going to pull my credit report and check). I have read quite a few negative things about dealing with this firm. In my research I found letters that tell the CA you want to deal with the original creditor. Does the CA have to let you do this? And can the CA continue to try to collect on the debt while you do this? This is an old chevron account and I want to take care of it if I still have to but I would prefer not to deal with this firm. I was in a debt management program several years ago and I am finding it was not a completely honest one. Things I thought were paid were not. I want to fufil whatever obligations I have and I do not want to be sued trying to do it.


i would try to contact the OC.you might be able to work with them.however,if this debt is in the hands of this bottomfeeder.chances are it was sold to them.making the OC moot.it's worth a try though.

Thanks Paul. I have been waiting for their replies on validation before I start all my digging. I was hoping they would not be able to validate and I am weighing my options in case they do. I have been going between here and researching on Budd Hibbs to try and determine what course of action I need to take in case. My last correspondence with them consisted of them sending me a letter telling me they are getting the documentation together and will be mailing it to me and be assured no attorney is aware of my case yet....kinda took that as a threat. Like they are trying to scare me.

Roxy- there is a chance that you may not receive validation. Some of the CA"s don't validate- but not sure if this is one of them--I know LVNV is.

If you have any papers from your Chevron account, maybe you can look up your account with them on the web(their site).

I had an account with a cc who had charged our debt off. I started taking care of my debt after a period of time and noticed this. I called them and they luckily still had the papers, so I was able to pay them.

Of course this only works if they still have the debt and haven't sold it to an agency--good luck!!..Let us know what happens..karen :D

Thanks Karen - I will go ahead and pull my credit report to see where this is on there.

If a CA does not validate or does like another one did to me and sends a debt verification notice...what do I do next? (the one who sent the debt verification was for an illegal pdl so I am not worried I paid 1200 on a 400 loan...) I would like to know in case MNK does not provide what I requested per the law for validation.

well looking at the whole thread,they already violated the FDCPA.they are continuing collection activity after proper validation was requested.i would send a letter reminding them of this.
