After about a million phone calls from them I finally answered the phone...as I was now willing/able to deal with them. I spoke to them in early Dec. I told them what options I had, monthly payment would be great for me but they pushed on a one time settlement for about 1/2 of my amount due. I said yes to it but would be able to pay it off until Jan. 09. They pushed and said it would be too late for this deal, it had to go through no later then 12/31/08. I agreed. I honestly thought I would have all of the funds available as I was to get a bonus from my boss. I then found out that we wouldn't be getting out bonus until Jan. 09. I lost their number and with the holidays and all I called Chase today and got the name of the agency...turned out to be MRS associates. I called them and told them that the funds would not be available etc. and I did want to work something out with them for Jan. 09, they accused me of refusing settlement, sending bad check over state lines etc. There was not working with them...they were pissed. I had no choice but to call my bank and put a stop payment on it.....what's going/can MRS Associated do now?


They cannot do squat . You called and informed them that the funds are not available and they are choosing to process the check . They are also indirectly accused you of a criminal act with is an 1. Personally I would put a stop pay on it and send a C&D telling them to FOAD.. .they aint getting nothing from you . Also call chase and let them know that they are costing YOU money for a stop pay. ACH checks can easily be cancelled ...they are simply choosing not to .

I know this is a bit late but I am new to these forums...Actually that isn't necessarily true soaplady. I work for MRS associates and I know standard procedure and most of this conversation sounds like a pretty by the book thing. The thing is if hope called on the day of the payment as it seems then it was too late, we had already submitted the payment to the bank. And from the impression I got in the wording it sounds like she knew before today about the bonus and waited until the last second to tell us. Personally I would consider that the actual qualification of knowingly passing a bad check across state lines. Tell me if hope gave someone a check with the intention that it was to be deposited on the 31st. And then decided not to get in touch with them immediately upon knowing it wasn't going to be good and called them after they already went to the bank wouldn't you think there was something wrong with that?

While it was certainly irresponsible, you would have an impossible time trying to prove any fraud so you might as well drop that cannard right now. PLUS, she stated that she told you she couldn't pay it but was PRESSURED into promising an earlier date. So who is the fraud here? NOT THE DEBTOR!!

And what does MRS know about standard operating procedure, at least in a reasonable business sense?
