After bouncing from CA to CA, my account (formaly of BofA) is now in the hands of Forster and Garber which I understand are collection attorneys. I have sent them a DV letter, however, they have not responded. Is this the proper protocol being that they're collection attorneys and not a CA? If I don't here from them by mail, should I call them? Am I doing the wrong thing by asking them to validate a debt? I want to get the ball rolling but they don't seem to.


No, jon, they do not have to respond within 30 days of receiving the DV request. There is only one state where this is true--Texas. For the rest of the country, there is no time limit. They could respond to it a year from now and then legally begin collection efforts. Please consider the information you are putting out there--putting false information is a fine way to get people sued. We do not take this lightly here.

I do want to settle this account as soon as possible. I will try again within 2 months. I guess they're busy with other accounts, otherwise, I don't understand why they wouldn't go about settling it.

are you referring to their lack of DV response? that has nothing to do with their willingness to settle. it's possible they had to make a request for the proper documents to validate, which may take time. it's also possible they can't validate at all! in either case they would be MORE than happy to settle with you, i'm sure (especially if they CANT validate), but you should wait for their response (or lack thereof) first.
