I wasn't able to locate the original thread but I posted within the last couple months about a letter from Mann Bracken saying they were going to send my account to arbitration and my post was a question about how to handle it. A member responded that I should send a DV letter, as well as letter denying participating in the arbitration and I did that.

Now, I get another letter from MB saying that a Document Hearing will be scheduled within the next 30 days and if I have any supporting documents to send them to the National Arbitration Forum. They also sent me a 3 page resume of the arbitrator for this particular case, but I have no experience with arbitration so that may be the way it is typically.

Does anyone have suggestions on how to proceed? Should I send them another DV letter? Any thoughts would be most appreciated.


Did you send the DV certified mail, return receipt? Did they receive it prior to filling the abritration? If not then they are in violation.

What state do you live in?

Did they provide anything that said you agreed to Abritration?

I once had a CA send me to arbritration and they tried to serve me via UPS, I came home each day and found the yellow tag on my door saying that an attempt at delivery had been made. When I tracked the first tag and found out who it was from I just ignored it. Eventually the tracking said it was delivered by the driver without a signature, I found it about a month and a half later when I was trimming some bushes. About a month after that I received a letter stating that the case had been dropped. Probably because they could not prove delivery.

I sent them a DV letter initially, not certified then they sent me an arbitration hearing doc, I sent them a letter denying the arbitration hearing certified and return receipt, then I get the letter for the document hearing. I haven't responded to it and it wasn't sent certified either. Unfortunately, I was home when the Fedex driver delivered mine and without thinking, I signed for it right away. DOH! I'm just wondering if anyone else has gone through this part, the document hearing. It sounds to me something like discovery.
