I just now received a call from National Processing. I got a payday loan about a year ago and after a while couldnt continue to pay. I tried to enter payment arrangements, but they refused. they wanted it all at once and would let me pay monthly. I am in new mexico.
today national processing called me from 904-725-3922. they told me that they were process servers and were going to have me served for defrauding my bank for writing them a check that wasnt any good. i asked them if they were a collection agency and they said no. They told me they the finance company's attorney was craig gibbs in duvall county in florida. they told me i had until 2:00 pm todat to pay. i cant of course so he hung up on me. I am a little nervous. i offered to make him monthly payments too and he refused. can i get served papers for fraud? if not will they indeed sue me? can they sue me from florida? i am in the finance industry now and i am concerned i could lose my job if they find out.


I think they are just trying to scare you. Does this sound similar to the tactics used by Ellis Crosby in Florida? Could it be the same people? He is trying to get you for your money. If they wanted to sue you they would have to sue you in your state and if they wanted to do they I believe 1)They would have to show up 2)Or hire somebody in your state to do it for them. I doubt they are processing anything more than crap.Find out your pdl laws in AZ the company is required to follow your state pdl laws regardless of what they tell you. Find out how much you have paid in interest. Was it way more than the principal and the allowable interest rate allowed by AZ? Chances are you have more than paid the debt. You did not commit fraud. Read more on this site, you will see that many of us are or have been in your situation with similar threats you will get alot of useful info. here.

Yes he more than likely got it from your app. I got a call from a lady stating in very poor English "I Affidavit lady official with court" Spatted off all my info. she got upset when I wasn't phased by her threats of fraud and transferred me to another man he as well became frustrated when I laughed at him. I even read definition from the dictionary to them explaining they aren't even using the correct terms to threaten me with. Told them I wanted to discuss this, they got upset and hung up and now refuse my calls. She must be writing another one of her delusional affidavits. They called from a cell phone of all things.

This National Processors keep calling my 10 year old son's cell phone. Don't know how they got his number and he is on the "Do Not Call Registry". They call and try and intimidate him and he hangs up not understanding what is going on. I called them today and I asked them what business they have calling a 10 year old boy. They hung up. What is going on?

i have been getting calls from national processors in austin tx. they 2 say they are investigators and also called my daughter's house(her phone is not in her name). How they got the info i don't know. the 1st call i received the lady said they were going to file hot checks charges on me for a payday loan i had 5 years ago. If they call me again i am going to tell them i'll meet them at the court house..do whatcha gotta do. i hat those scare tactics, another collection company called my job several years ago saying they were sending a sheriff deputy to my job to arrest me. I contacted Bud hibbs and he took care of them. ha

Record all info when thay called and such, call a attourney and show him when the calls were made and how often he could sue them, or just tell them you have hired an Attourney at Law give his name and niumber then hang up if they continue to harass you and your son, he can sue them for the whole amount of the loan!!!
