Does anyone know anything about NSB? Here is the situation:
I pulled my credit report and sent DV letters CM/RRR to the 6 collections tradelines on there. My ultimate purpose here is to pay what I owe and have the lines removed. One of the letters was sent to Seattle Service Bureau, which I have since discovered is a branch of National Service Bureau. I have not yet recieved my green cards back, but I checked online tracking and found that all letters were delivered as of Monday 07/28/08. Since Monday, I have been getting daily calls from Craig at NSB on both my work line and my cell. He will leave a message stating his name, that he is from NSB, and that he needs a call back either today or asap. The number he is calling from is 206-533-0963, and the callback number is 800-798-1674 (putting this in in case anyone needs it). The item in question is a PDL that I had defaulted on in late 06 from Magnum Funding. I cannot find Magnum Funding as being licensed in IL (IL DFI database search). I have no problem with paying back the remainder of the principle, which is $455 according to old bank records (closed account). The TL is listed at $1700 on my credit report.
I am planning on calling him back this week, in the evening (I will not speak to them during my working hours). I have not done so yet because I just got the call recording software loaded on my phone last evening. Here is my plan of attack on this account:
Section 1, the collection agency:
1. I will inform him that I am recording this call and request that he acknowledge this fact. If he does not agree, he is welcome to contact me via USPS only.
2. I need for him to provide me with bond and/or license numbers that authorize his company to collect in IL. If he does not have this information, he is welcome to inform me as to where it can be found and either wait while I look it up or I will call him back once it is confirmed.
3. I need to know whether his company was assigned the debt (original creditor owns) or purchased it (NSB owns).
Section 2, the debt itself (once it has been confirmed that NSB can collect this debt from me)
1. I will request that he email me what he has, specifically original contract, interest calculations, and payment history. Any valid creditor should have this information. If he cannot email, he needs to verbally give me the information and mail me a hard copy.
2. I will then be be requesting that the debt be returned to the original creditor if NSB has been assigned.
3. If he refuses, or NSB has purchased the debt, I will inform him that the original debt was an illegal pdl. IL state law states that all money-lenders must be licensed by IL and conform to IL laws in order to do business here. Clauses that contradict IL law are considered null.
4. I will then offer a settlement amount of $455 (remainder of principle), to be paid in monthly installments (I'll offer $75/month, and go up to $100 to appease). The stipulations on this settlement are that the payments will be made via postal money order, the TL is completely removed from my report, and his company agrees to never sell nor attempt to collect on this debt again.
5. If he refuses to agree to the settlement or terms and conditions, I will then inform him of my intention to file complaints with the BBB, FTC, and IL AG.
So, on to the questions:
Is this gentleman in violation for contacting me prior to debt validation? Bear in mind, that I do not believe that I have ever spoken with this company, as I generally do not answer calls that I do not know the number. I do know I have never gotten anything in writing.
Second, does my plan of attack look good? Is there anything that should be added, changed, or taken out completely?

Did you put anything in your DV's about "All calls to my home are recorded"? If so, since they have signed for your DV letter, you have informed them that all calls to your home are recorded and by calling you the are agreeing to being recorded.

Nah, didn't think to do that. Wasn't even sure I would be able to record, as my old method has been discontinued (Grand Central no longer allows recording of outgoing calls), but I found some software that works with my phone.
I figure, if he doesn't want to be recorded, he will state this and he can either not call or switch me to someone who doesn't mind. (also, if he doesn't, what is he trying to hide??)
I'll add that to my template, though, that's a really good idea. I can bury it under other stuff that they normally do not read, like they do to us.

I just got off the phone with Craig at NSB, here's the rundown of the conversation:
Very professional, I was actually kind of impressed (I appreciate professionalism), and had no problem with being recorded. However, he could not provide me with bond information per IL laws, but understood when I explained that I need that information to have all of my ducks in a row. He then asked me to verify the debt, which I refused to do. He also asked me to confirm that I had spoken to someone at his company last year, which I again was (honestly) unable to verify. I did inform him that if they had a record of it, it was possible. I informed him that I had researched the item based on the tradeline on my credit and determined it to be either a payday loan or installment loan. He confirmed that that was the information that he had and asked me to verify the debt again. I refused. I then asked him to confirm if his company was assigned or purchased the debt. He stated that they were assigned the debt, but also stated that they were a third party collection agency (I was under the impression that 3rd party meant that they purchased, but whatever). Then I informed him of IL law that requires all money-lenders to be licensed by the state, and that I was unable to find any license info on the IL DFI search database. I did allow that this information may not have been entered, and that I would accept the information if they could provide me with that. He then got frustrated and stated that the conversation was not going anywhere (or at least not anywhere that would get him a bonus of any kind), and offered to have the client send me all of the relevant documents, which I agreed to, and asked that they include all relevant license information for the original, and the bond information for NSB.
So now I play the waiting game, although I imagine that they will be sending that pretty quickly (if they can).
If they decide to sue me for garnishment instead, would I be able to get a continuance or dismissal based on the fact that he agree to have the information sent to me prior to further contact or negotiations?

Dear DEADBEAT PDL third party collection agencies,
Instead of going on the boards, trolling on the boards get a life, and stop harrassing ppl. Remember when you go to sleep at night, dream of how you wake up and not realize what a scumbag you really are? I'm no the most religious person, however I don't understand how you think you can play god, just because you're a bill collector. All bill collectors are scum mostly, overpowered low-life pieces of shit scum. I hope you croak in your sleep. Then you won't be able to wake up and be more of a low-life scum to descent ppl that deserve a break. Tootles. BTW Magnum and your so-called thirty party illegal bottom-feeder collection techniques are going to get sued in a class action law suit. These pigs pound my phone with an auto dialer and now THREE TIMES I've hit the button to speak to a rep, wait, and ask that they remove the number from their auto-dialer since it is now a commercial number and the person they are looking for no longer is at this number.
Rather than comply, like professionals, these scum sucking worthless waste of life piece of garbage whose ATTACK REMOVED hang up EVERY SINGLE TIME without saying a word. Like I was bothering them by asking them to not call my REAL business wasting my time when they are too lazy to make the calls themselves and use an auto dialer.
