I have been having some issues with a couple of collection agencys lateley.First is NCO.It is on a Capital One account. I sent them a validation letter(certified) on January 9,2008. Since that request they have sent me 2 letters (it is tax season here is your special offer) and 9 phone calls to contact Aaron Million in an attempt to collect on a debt. I know they are in violation, but who should I contact about it and is it worth my while?
Second is with Harris & Dial. On February 26,2008 a woman named Kate called me at work (she told me it was the only number she had) about another Capital One account. I told her I believe that some other agency has contatcted me about that account(NCO and ASG) I sent them both letters with no validation. I told Kate I would like verification. She told me she could do that but it just delays the process and hung up on me. No letter in the mail within 5 days. Today on my cell I get a call from Sally from Harris & Dial to contact their office. Are they too in violation?
Thanks for any advice.

You need to send them Cease Communiction letters. If they continued to collect after a request for validation they are in violation of the fdcpa. If they call you at work after being informed that you are not permitted those calls that is another violation. If they call after the cease communication letters you have a third. Get a lawyer from the NACA and sue them. Many will take the case on a contingency basis. I have a consultation with one tonight for similar acts. I will let you know how it goes!

NFO got my certified letter to cease as well as validate, but has sent 2 additional letters as well as 9 phone calls.Harris & Dial I had that 1 call at work, no letter within 5 days and another call on my cell today. I have the letter ready for Harris & Dial, but I never got the letter after the first communication. So I was wondering how to deal with them.

This group left a threatning message on my answering machine looking for my x husband, we have been divorced 20 years, said he gave them my number, doubt it.Rachel Lord Esq took my attorney call and lied about being a collection agency and tried to extract information about me. Be cautious when getting a call about your relatives and X'S these are the New American Terrorist welcome to America.

According to this thread, there are, "32 CA's with Violations." I'm wondering if anyone can tell me where I can find the list of CA's. Or...did I misunderstand the 'subject' of the thread?

hiya Debbie--

I will take these one at a time, since each CA youre talking to has violations.

First, NCO. you asked for validation, by certified mail. Do you still have the green USPS receipt card? I hope so, because that is all the proof you need on that violation.

1--continuing collection activity while ignoring a validation request. This is a violation of the fdcpa, and the penalty is $1000.00 payable to you, plus any actual damages, court costs, attorney's fees, etc etc.

Harris & Dial--on the Cap One account. They have not really violated anything as of yet, except for not sending the notice within 5 days. Again, this is worth $1000 in your pocket. You told the woman that you wanted validation of the debt, but unless you recorded the call, there is no way to prove that you asked for that. So, any other calls they have made since they do not technically break the law. What you need to do is send the validation request in writing, in a certified letter.

Also, I dont have all the details, there may be more violations. For example, I dont know if any of these are being reported on your credit bureau reports. But with just the info you provided, there you go.
