I have recently begun paying off my creditors, and everything has been going well until I encountered a particular company: NCO Financial. This company would call my cell phone 1-3 times a day, providing me with different offers which when pressed the supervisors would deny that their agents had clearance to give such offers and that all offers came through a supervisor. My two accounts were for $400+ and $80. I called them May 6th in an attempt to make settlement, and after the initial agent made me an offer I asked about the previous day's offer to which he told me that the offers vary day to day and put me on with his supervisor. This supervisor was extremely rude. He denied that he had offered me less, and in addition to not giving me the initial offer, when I requested a bill through the mail, he refused to process my request; flat out telling me that he wasn't going to do that as it would cost his company money. I quickly asked for his boss and attempted to explain to her the situation. She took the previous supervisors offer and added an extra $10 to spite me.(When I asked why there was an extra ten dollars she mocked me saying that she doubted $10 would make a difference in my life) I had had about enough of this company when she informed me that the settlement amount was for both accounts rather than only one(the supervisor would not group the two) to which I agreed as this was the initial amount albeit $20 bucks more than was offered to me the week before. I asked this manager three times to verify for myself as this seemed fishy that this in fact would wipe out both accounts, and all debts with the company. She told me that it would and it would wash out. I made the inflated settlement($365+$10 transaction fee) and took her name and a transaction number for further reference. Tuesday, today, I received a phone call from none other than NCO financial stating that I had authorized a payment of $80 to close out one of my outstanding accounts today. I was also informed that NCO financial had another active debt on me that they would pursue as well. I informed the agent that I had not approved the payment, as I had settled friday and was assured that my debt with the company was settled. He moved me on to a supervisor who informed me that NCO Financial has two separate departments and that I had only dealt with one of them. I told the supervisor what I had told the agent before him, and he said that it was a misunderstanding and human error. I then told him that it was deceptive, and that I had been given a deal on false pretenses, and that if my debt would not have been cleared the manager should not have stated so. He again informed me that it had been human error, to which I replied that I believe that is considered fraud, not error. He said there was nothing that he could do, and that they would still need to collect the debt. I informed him that I would take legal action against his company if he called to collect the debt, and he said he marked my file so that they would not call me; I told him that I was going to take issue with the FTC as I considered this an unfair business practice. He gave me an 800 number to call(his companies compliance number) and we hung up. Where do I go from here, and what are my options?

Put an ACH block on your account so they can't withdraw any more
Put an ACH block on your account so they can't withdraw any more money, or close your account. Get a free consultation with an attorney that deals with consumer complaints (not a jack-of-all-trades). You might have grounds for a lawsuit. If you do, the attorney will take your case and then you can refer NCO to him. Usually you don't pay anything as attorney fees are paid out of the settlement. or you could tell NCO that you recorded the settlement and you are consulting an attorney. See what their reaction is.
