How to negotiate a lower payment with ARS National

I received a call from ARS National at my place of employment at 2:15pm yesterday, then at 2:28pm my Manager forwarded a voicemail from them that was left on her extension that was for me.

Well today I receive a call from them on my personal phone. I called the number back to see what the situation was about. I spoke with Jose Garcia and I explained to him that I am unable to pay this debt as I've been under medical care and I'm more worried about saving my own life. He explained he's heard that numerous times and flat out called me a liar. Understandable as he probably deals with that everyday. Well when I told him I wouldn't pay it he got very defensive and basically said that Citibank is in the process of garnishing my wages. I was in the car so I couldn't do a lot of research so I didn't agree to anything. He said that if I send a postdated check by 6/28 (7 days from now) then they will forgive the debt of $1700.00. I told him that I wanted this in writing and he bascially said no. He said I can't send it by mail but I will e-mail it to you and it will take 10 minutes. Well that was 45 minutes ago and I haven't received anything.

Is this guy bogus? I don't know what to do. I'm working with Wachovia for a credit card of the same amount and I'm paying $80 a month and they're perfectly content with that. Why can't I negotiate a lower payment with ARS? I'm on a debt consolidation plan with another company to take care of my Citi card debt. I was also thinking, doesn't ARS own the debt now and not Citibank? If Citibank doesn't own it anymore they shouldn't be garnishing my wages, ARS should. Am I right? Please give me some insight!


Tell me what there phone number is, and I can find out if they are bogus. Most are by the way, but I can find out for you.

Here is how this group of 'Legalized Racketeering' works:

Ameriquest Recovery Systems, LLC (ARS) is owned by Ed Reiner, Joseph Reiner, Bob Peterson, Ed Reiner JR, and Tony Reiner. They have the franchise agreement with Collect America, they are the ones that purchase the debt. ARS is a "client" of DeJana and Associates (RDA), in their client agreement ARS is to pay all the overhead for the Law Office and supervise the Law Office Personnel as it pertains to the "collection" of ARS accounts. None of the collector/paralegals ever do any legal work for DeJana, they only collect for ARS. Then on a monthly basis, DeJana gets a % of the recoveries. DeJana does not supervise the collectors, they are supervised by ED, Joseph, and Bob. DeJana has almost nothing to do with the collections process or daily operations. Collect America routinely sends people out to audit RDA and gives seminars and the like to the franchises.

ED, Joseph, and Bob are horrible they treat their collectors like they are dirt and they direct their collectors to treat the debtors like "scum."

One more wasted law license lost to a greedy, ambitious debt collector who preys on consumers with his Con America attitude and goons. It makes me wonder if perhaps our law schools are too lenient in their approval of potential law candidates. How does a law license get wasted like this??
