Hi, I have this nasty best buy hbsc bill that has been lingerning around since 2002 2003ish, that has gone to Nelson Watson for a while now. I have been managing to avoid them for a while, and of course I have been out of work and got this custody battle going on and mistakenly in my moment of weakness, took a call from them based on them posing as a law firm. Because of my other litagation with the custody thing, I made a payment of 100 dollars on this bill because they were threating suit and kept me on the phone forever and I have a lot going on. Now, there is no way to pay this bill, because it originally was like 1300 and now it is 2900. The offered a settlement of 1880 verbally, but in a lump some which as you probably know aint gonna happen. What can I do if anything to get these people off my back for now and pay this off in the smallest amount possible. Oh and can they freeze my accounts for this or anything??


I wish you hadn't made that payment. SOL in PA is 4 years and their threat of legal action violated the fdcpa since this debt is out of statute. Your payment may have reset the SOL as well. Start researching your state laws to see if it did. I know in some states that you must promise or acknowledge the debt in writing in order for SOL to reset. I do not think PA is one of those states however.

I wish I hadn't either. I am an idiot. But my x is suing me for custody based on the fact I am "financially unstable" so the idea of getting sued got to me to do a check by phone. My credit is in bad shape from a while ago, when I had an accident, and just gave up on a lot of bills. I work, but took fmla leave because my 3 yr old was not handling the separation well. This all started over a broken laptop best buy originally would not fix. Any ideas on what to do now they have called me 6 times today on my cell and it is only noon here.

the payment cleared today. I told them I would not make any other agreements without anything in writing. But I did manage to squeeze that settlement amount out of them which personally is still way over what the original bill was. Isn;t there some crazy loophole that they can't collect over the original amount?? I;m not saying I wont ever pay, just not at that amount.

I'd dispute the charge with your bank since they used extortion to obtain money from you. As far as the inflated amount goes, your cardholder agreeement would outline the amount of interest charged and late fees, over the limit fees, etc. Those rights are generally assigned with thte debt so while it seems like BS(It is), it is legal.

so bear with me I am new here and to this........

1. If I dispute this with my bank, how do I explain it to them without sounding insane. ie, I authorized a payment but didn;t really want to make it??

2. Should I close that account??
3. There is a lot of information about how Nelson treats people poorly and no one ever seeems to get any results for that. It is like they operate on the fine line and just squeek by. Is reporting them worth it?

4. Do you think the bill will ever get any better offer than the verbal one they gave me over the phone, and how do I get that in writing?

5. They just called me again , that is 8 today and it started at 8:30 am. If I pick up can I tell them to mail me an offer or send them a dv or something to stall the situation until I can get the money.

6. Like I said, I am in a particularally bad time in my life for this to happen, any advice you can give would be great. Thank you :D

I would go in and talk to the bank manager and explain that you gave out your bank information under duress. Threats to take legal action on a time barred debt are empty threats.

After you have that taken care of, answer the phone and tell them that they had 5 days from their initial contact with you to have sent you details of the debt. If it's been longer than 5 days already, tell them they are in violation of the fdcpa and your next step will be contacting the PA AG and the AG in their state. Verify your mailing address and then end the call. Do not allow them to engage you in any further conversation. When you get something in the mail, immediately send them a request for debt validation. Inform them that all calls to your employer place your employment in jeopardy and at the bottom:

[center:774749576d]ALL CALLS TO MY HOME AND CELL ARE RECORDED[/center:774749576d]

Since PA is a 2 party state you must have their permission to record. By adding that to your DV, they have been informed of the recording when they signed for the DV. If they call you after receipt, they are giving you permission to record.

well, I somehow didn't exist when I logged back in, so here I am. :D Thank you for your help, I really appreciate it. I almost have to wonder, have you recovered from a ton of debt, or do you work in the industry, either way I am grateful you know your stuff.
So after I send the DV and that jazz, and they send me some sort of mail, what do I do then. I really don't get this place, because I have almost fixed every bad cc that I had, one for 14000, with the former mbna that is being paid at 220 per month moved to 1 percent and has been that way for 5 years. and I pay it every month. I made the bill, I pay the bill. I also paid off chase twice they had screwed me on a settlement deal that ended up me paying 3900 twice on their mistake. After that my idenity was stolen and used in a crime believe it or not. Those places were so cooperative and the bill were in much more trouble than this place. I currently boycott best buy to this day from this.
How do you find out more about your state laws and stuff for this??

and more importantly, how do you rebuild after falling apart. My credit is still horrible and I settled and paid a ton of bills that sit on my credit report today as "settled for less than the full amount".

yeah, so I told Nelson watsons ever so indignant representive what ya told me to and ...... He told me I already admitted to the debt verbally on one of those long calls they made to me. I know I told them I wasn't saying I wouldn't pay, but not so sure if I admitted it. Maybe I did. Can I still fire off that letter? Im pretty sure that was the same call that the guy insulted me by saying I was a deadbeat and told me that people like me do this all the time and expect to get away with it. And the calls continue.... Seriously I could pay this bill if it was broken down to a more reasonable amt of time, and they keep adding interest to this bill, so how the hell are you supposed to pay it.

Nelson Watson and ASS. are the most unprofessional bunch of heartless blood sucking jerk I have ever talked to. They will not quit calling my home and it is the WRONG NUMBER the person they are looking for I don't even know so I can get as rude as I want you guy's ALL need to contact your Attorney General.
