Nelson Watson & Associates - are they collecting debt for LVNV?

I know most of the fdcpa now but didn't in 2007.
I was sent a Letter dated 09/12/07 from Nelson Watson & associates. It demanded payment, said they are a debt collector but never put in the letter my 30 day right to dispute.

The next letter I got was from Lustig Glaser & Wilson
dated 10/16/07. I never responded and now I am fighting it in court.

Can I go after Nelson Watson & Associates for turning it over like that and failing to put in the disclosure?

NW&A said they are collecting for LVNV Funding. The same goes for the LG&W who is suing me. LG&W got the account not even 30 days after the letter from NW&A so I think they are not collecting for LVNV Funding.

I had just about the same thing happen. I filed a counter claim against the collection company who filed in court and it was all dismissed the day of the hearing, basically because they didn't have anything to prove it was mine because they had "purchased" it from a collection agency who purchased it from the original credit card company. I didn't hire an attorney, I just completed a counter claim, took it to the courts where they filed, had it filed and it went fromt here.

Yes the very first letter I got was from Nelson watson. It didn't have the 30 day disclosure.

About one month later I get a letter from LG&W but it did have the disclosure, at that time I didn't know my rights, I thought it was a scam.

I only found out my rights 3 months ago, after I filed an answer to LG & W. I requested validation during discovery but they said that the C&D was for in writing too but the letter said they could only respond in writing if it was for validation.

Nelson would be in violation for failure of notice,but if that is only violation I would not go after them.LG & W are arguing semantics & basically bulldozing you with garbage. Any communications during a lawsuit are permitted and really required to keep the case moving. If they have not yet complied with discovery,send them a final letter explaining the next letter will be a motion to compel discovery from the judge.Good luck.

You don't mention whether this is a valid debt or if you contacted the attorney after receiving the first letter...
Instead of seeking legal counsel here, you might consider seeking out a consumer rights attorney near your home.

I did send a validation letter during discovery. They did not respond and every time I call to talk to the attorney on the case, he isn't there. The attorney who filed all the papers with the court is the president of the company but he is not the one on the case. They won't let me talk to him either. I thought that if a different attorney was working on the case, he would have to be listed.

I found about 5 errors on the signed affidavits by the president of the company. If he was such a good attorney, he said in the affidavit he is very familiar with the case, but one would think he would look over what he is signing. They are not typo's. In March they where asking for one amount, in May the same amount on page one but go to the 3rd page and the amount is less.

I was served by our Sheriffs in January09 that the firm of Lustig Glaser & Wilsons bringin me to court on behalf of First Resololution Investment Corp. I thought it was a scam as I had never heard of FRIC of LGW before. I was already in negotiations with Arrow for the same thing . Is there anything I can do to complete my negotiations with arrow, then go to court next month and prove the resolution with another firm? How many agencies can go after you at the same time?

Are you in Massachusetts?

If so dispute the fact that FRIC is not licensed to collect debt in Massachusetts.

Is the name of the attorney Kenneth C. Wilson? If so dispute that too. Bring up the fact that he purchases debts under a different business name, HEMLOCK GORGE HOLDINGS, LTD. which is not a law firm and no debt collectors work for his law firm. It is all another company that he owns that is operated from the same building. HEMLOCK GORGE HOLDINGS, LTD. Is NOT licensed to collect debt in Massachusetts either.

What are they suing you for and when was the last time a payment was made?
