Update on NES troubles..

I got about 10 more phone calls today. Mr. McElrath left a message on both my house phone and cell phone that said the following:
"Uh John, just calling to let you know we already processed the checks in our office. Obviously you haven't called us back so we assumed everything is a go."
Now, my husband foolishly gave them our bank account numbers in the middle of October. They called him at work and was harassing him. He gave them the check numbers and told them we MIGHT be able to come up with the money by the end of the month. He never gave them a specific date. Now they are saying they are cashing the checks!
I went to the bank and pulled out every last dime I had out of my account. And notified the bank of whats going on. Is what they are doing illegal? They said that they sent us a letter notifying us that the payment would be removed on the 25th. But I never agreed to that or received any paper in the mail.

Technically not...however the collector made an assumption. You should have received a letter in advance telling you that the check was going to be presented.
Put a stop payment and/or hard block on anythng coming thru from NES. You do not want an NSF.
