I don't know who this will help but i know that this site really helped me ......because Mr. Ryhart from NRS had me very very scared.
May 28th 2009 i received a call from NRS stating that i was being sued for fraud and that basically i had to pay 690 by the end of the business day. or they were going to send out documentation to my state county office.
These people are harrassers. Not only did this man call almost everyone in my hr dept with no avail. But he actually call my direct job line and told me to transfer him to the management department. WHen he was told that he was speaking to me he rudely say i don't want to speak to you i would like for you to transfer me to the management department.
They also called my two friends that i used for references. But i had already warned them to not fall into the propaganda.
Funny enough i tried to contact them (NRS) to get their address and some guy refused to give it to me.

They will say and do absolutely anything they can to scare you. No matter how many times you tell them not to contact you at your place of employment, they still do. It is against the law and they use every single illegal way possible to get you to pay them much more than what is owed. Every single person there is rude. They all have fake names since that is how these collection agencies work. If they used their real names, they would be stalked and murdered due to how they treat people. They sometimes will use other tactics to see what they can get out of you. Sucha as being nice, but only until you ask for paperwork and then they turn into the devil.
They will never ever send you any type of legal documentation. This is ALSO against the law. if they don't send you any legal documentation, what are they presenting in court? Also if you know the companies they have as accounts and you know that you owe money, send a small payment a month, until they send legal documentation. Have your place of employment send a certified letter saying they may not contact you there or anyone else there for that matter, they must abide by that. They have many complaints with BBB's in different states, as well as the FTC.

Pay something so you are showing you are trying to pay. Other than that, that's all they get until they show and itemized list of what you owe and why. These questions are very relevant because your question cannot be even half way decently answered without this info (if there is something illegal going on then there is no way they would ever sue you at all, but if it is legitimate then you certainly *can* take you to court). So are you saying you borrowed but never paid them back a dime until it went to collections? How did you pay, by a prepaid debit card or money order in the mail?

I'd say that it might be the Electronic Payment Processor and not the PDL itself, but I'm not sure (the PDL experts hang out in the PDL forum).
If you looked at the website I provided above, you will see that only ONE PDL is allowed at any one time, in the state of California. Acceptable interest is 459% APR (which is $17.65 per $100 for 2 weeks). The max loanable is $300 and ONLY ONE LOAN AT A TIME is legal, with free EPP (Extended Payment Plan) available. No rollovers allowed, and 1 (free) extension is allowed.
Anything past this is illegal and in that case you would be only responsible to pay back the original principal amount (and don't listen to them when they tell you nonsense like the Laws of Malta or something).
So, only the FIRST loan needs to be paid back with the high interest, the rest only the principal.
First, head over to the Payday Loan forum where nearly every PDL has been discussed (you can also use the Search box). Addresses and phone #s will be there. Write letters to all the PDLs after the 1st one, that you took out *at the same time as you had another open*and let them know the Calif law that only one PDL at a time is legal, and if you have paid the principal, then ask for a Paid in Full letter. If you have paid too much, ask for a refund of the balance (you may not get it, but it's worth a try).
Check out the link I posted above, it has a link on it to all legally licensed to operate in Calif. PDLs. The ones not on that list are also included in the "pay principal only" stack. File a complaint against the other companies. File a complaint against every company that loaned to you when you already had an outstanding PDL, and any company that let you roll your loan over, etc. Also file a complaint against the same companies with the FTC and the State Attorney General. The ones that are paid, request a Paid-In-Full letter and that the account be closed and any collections be ceased immediately. The ones that aren't finished being paid, see if you can pay the remainder of the loan when you write. Include proof of payments. (For example - you have a $300 loan. You have receipts that prove you paid $290. Send them $10 and be done with it).
Oh, and you should close your bank account. A link explaining why it's recommended is on the following thread, which you should also read: Dealing With Illegal Payday Lenders.
And the most important advice? NEVER GET A PAYDAY LOAN AGAIN!!!!

The man was extremely hostile and when I spelled my name(because he couldn't understand) he said he knew that I was spelling it fast for deceptive reasons. He asked if I knew 3 different people, I replied that no one by those names lived in the house. I had no clue who they were, only people with the same last name. He then proceeded to call me a liar and because I said "this house" it proved that I knew them. At that point I told them that they had called my phone and harassed me and never to call my phone again. The man Hal Jordan, or something like that was very threatening. What recourse do I or any one else have in situations like this? This was not even about me, but about someone who had put my name as a reference. This type of scare tactics should not be allowed and it has to be stopped.

Yes, they are awful. They called my Mom and threatened her too with the "we'll take you to court if you don't pay" line too. She almost believed it. Then I got on the line after she gave them authorization to talk with me. The "supervisor" asked me my name and my occupation. I told him my first name and told him my occupation was none of my business. I said that my Mom is represented and he gave me the whole spiel that this was a debt after bankruptcy and that after a discharge the attorney no longer represents my Mom. I then started to tell him that attorney-client relationship does not terminate based on a discharge. I had a feeling he didn't talk to them so I started giving him the name and number. He refused to take it down. He started getting rude. He said, "Oh, so you are just coming on the line talking big, but you don't know anything. That's okay, I have your name now so I can pull things on you." Uh uh. Big mistake. I asked for their contact information, and they refused to give it to me. I asked for something in writing, and they refused to give it to me, citing "fraud" and California state law. Excuse me? Last time I checked, bankruptcy was federal, and not state law jurisdiction. Hmmm...they were getting very fishy.
Here's the bottom line: Read up on the Fair Debt Collection Practices Act. Read it well. Particular, 15 U.S.C starting from section(s) 802 on. In particular, they need to stop calling your work when they are informed they are not authorized to call there. Verify this is a true debt by asking for a written piece of paper with their information on it, including phone number, any judgments, or proofs saying they have authorization to go after you and that your debt is sufficient. They are just looking to get as much from you as they can. If they are going to file a lawsuit, they would have already done so. You must be personally served, or sub-served, with a follow up copy of the Complaint, Summons, etc. via US Mail. I'm in California and checked --- no filing, no nothing yet.
As for their company information, for California you can just go on to the Secretary of State Website and do a search. They were tricky to find, but I found the following information if you would like it. I am going to have my law office follow up on better contact information too and I'll post it as soon as I find something.

DO NOT give them items such as a social security number or bank numbers, etc. It is illegal what they are doing. Call your BBB, make a complaint with the FTC, and contact your State Attorney General. Go on your credit reports and put at least a 90 day fraud charge. And, it is illegal also to say that they will seize property "if you don't pay." Get the facts straight before you do or agree to anything and ALWAYS get something in writing. Always check with your attorney too. I'm having my Mom do that.

The guy who said he was a supervisor, Mr. Slavia told me that if I did not pay $510 by 11:59pm tonight he would file fraud charges against me in my state. I only borrowed $300.00
I explained to him that my account had been closed because of overdrafts and that I did not have any way to contact the Loan advance company since it was online. The only correspondence I received from the company was an email saying my account had been sent to collections. When I called the company, National Credit Adjusters, they said my account had been sold and couldn't help me.
Noble contacted me today and the first guy Sergio seemed to want to help and make arrangements. Asked me what kind of payments arrangements I could make. When I told him he said he needed to check with the company and to hold on. His "supervisor" then got on the phone and told me arrangements were unacceptable and I had to pay in full today. He pretty much told me that I was a criminal and did not believe anything I had said.
This guy was very rude and refused to give me any info or address about his company. I told him I was going to contact an atty and he told me how can I do that if I can't even pay my bills?
I finally hung up on him and researched Noble on the internet. I guess I'll just have to wait and see what happens. I feel a little better though about the threats since reading the stories on here.

I spoke with the "director" at 11 am (on 7/23/09) and was told to wire funds to the company no later than 12 pm. If I didn't, they would send my work legal documents to garnish wages. When speaking to them, I was told that I committed a fraudulent crime against a federally insured bank and that they will sue me for criminal charges, which will require me to pay up to 3 times the value of my loan, the bank fees, legal fees, court fees and Nobel Recovery's fees. Said they only get paid when documents are served. But, Mr. Bowen of NRS says that I didn't sound like the typical "criminal" that he talks to. That I sound sincere in wanting to pay the debt. He would see what he could do to get me out of the "fraud" status if I made the payment today. He also states, several times, that they are NOT a collection agency, rather, they are a fraud department. Sounds to me like they are a collection agency. I spoke with an attorney today to discuss this company. I was told they were doing things illegally. Was advised to call the FTC to file a complaint against this harassing company.

I have done many research regarding consumer rights - to sum up... NOBEL RECOVERY SERVICES IS PRACTICING DEBT COLLECTIONS ILLEGALLY. They are using the scare tactics that cause stress and embarrassment with personal life and work.
After reading up on consumer rights from the attorney general's website, (CA), I have found that a class action lawsuit is possible if enough people/cases is brought. I don't know if this is something that I am willing to take part in now. All I want is for these people to practice debt collections legally and fair.
I guess this is a cry out to others, who are suffering like me. If there is anyone out there with the same issues and have found a way to resolve this - please reply to this.

I was just called about my son with the same complaint that he is being sued for fraud etc ... You all need to file complaints with the attorney general in your area. These guys need to be stopped. Do not send any money because that would be acknowledging that you have committed fraud.
