Just got a call from 716-871-9050, which turns out to Capital Management Services, LP. They didnt leave a message and I havent gotten a letter so no idea what this is about (meaning which credit card they are trying to collect on). Looked them up on Bud Hibbs site...not good.

Any words of wisdom or anything I should be wary of outside of the normal tactics?


Volley- did some checking and, unless I am mistaken-which is possible- they are associated with the Sherman group. The Sherman groups have so many DBAs, I would get a thousand points if listed them all :lol:

One of them is LVNV, who I have been dealing with, along with their many others. They collect on cc,personal loans,auto repossession notes, etc.

Make sure that IF you do talk with them- record if legal and take notes if not. I have a folder over 4 inches thick of notes, etc., That I have been dealing with. They break all sorts of regulations, are mean and hateful and love to intimidate people. If they know that you know your rights, they usually will pass you to another of their dbas. IF they even make an attempt to validate, it is jusst a paper saying you owe the money, and maybe a last payment.

I got a notice from them about a debt that was colledted more than 6 months ago. Meaning satisfied paid in full. They said after being extremely rude. Extremely. That they knew the debt was not valid but that it was my obligation to provide proof. Yeah you owe us money because we say so. And I do not mean they asked if I would please fax a copy. I mean RUDELY!!! That it was my obligation to do so.

I am dealing with Capital Management Services, LP too. They are trying to collect 2 debts. I sent them the initial validation letter and they sent me a bunch of statements from several years ago. I sent them a follow-up explaining precisely what I had already asked for. I haven't received anything yet. The SOL will be up on both of them in a couple of weeks anyway.

Captail managment is calling my parents home for me which I have not lived there for 8 years. They are extremely upset. I have sent them letters telling them to not call that number anymore and but they still do. I have not gotten any calls or letters at my address or phone number. I did put my correct phone number on the letter but told them to coorespond through email or usps. I also told them if they keep calling the old number that a harrassment suit would be filed. Any other suggestions to get them to stop calling there?

mandy,did you send your letters certified mail return receipt.if not resend that way,then if they continue to call period much less your folks you can and should seek damages for fdcpa violations.you should look into it now though.

My Discover account which charged off last month was turned over to Capital Management Services LP. In the roughly two weeks that they've been collecting this account, they've now called my mother-in-law and father regarding the debt (left messages on their machines). They did this under the guise of "trying to find me", even though they know they have my address and phone number.

The funny thing is, my wife isn't even listed on the credit card account. The card pre-dates our marriage by quite a few years. And I have never applied for credit or anything where I listed my mother-in-law on the application. I'm sure of that. So I have no idea how they tracked her down.

I sent out my validation request yesterday, so let's see what happens now.

for starters,the settlement agreement in writing.plus a written promise by them that they won't sell the forgiven portion.if they provide that,then go for it.if not then don't do it.
