I am sending a certified letter to them asking for validation and going to the court to let them know I am doing this to ask for time to find out more about the matter.
Am I going about this correctly?
DV is worthless now because you have already been sued. You nee
DV is worthless now because you have already been sued. You need to force them to prove the debt in court.
You need to file your answer with the court..stae it in plain terms something like:
Defendant has no knowledge of such debt and denies each and every claim.
You may want to go into a little more detail, depending on your unique situation. Such as did they EVER contact you about this debt? Have you sent a DV before? Etc. They will also need to have numbered answered (follow the way the summons is numbered and answer each numbered part)
You need to file discovery, you type up a set of items you want to see as proof of the claim such as signed contracts, last statement, proof of bond to collect in the state of Texas, etc. You then need to take them to court (3 copies) and get hem entered and a copy sent to the plaintiff.
Then if you get he required items, you can file to dismiss due to say SOL, since they will have provided the proof that the SOL has passed.
