I need your help!!! I received a "Marshal's Notice of Execution" on the mail today for a balance that I had with Bally's Total Fitness and I'm Going CRAZYYY can these people actually come to my house and take my things? OMG I don't know what to do. Has this happen to anyone that can tell me what to do PLEASEEE I'm Desperate!!!!! :(... :cry:


I recieved the same notice today.I'm going CRAZY too

Unless you have put up collateral for a debt, a collector CANNOT take your personal items. Know your rights against third party collection agencies. Do a google search for Fair Debt Collections Practices Act. If you owe a debt that you have not made attempts to pay on, the creditor can place a judgment against you (a court summons to verify you owe the debt). If you do not make any attempts to pay a judgment, then they can persue you further to garnish your wages or attach a lien against your checking account.

If they sued and got a judgment, it is possible for them to start to execute on that judgment. I would be more worried about your bank account or wages at this point. 9 times out of 10, the sheriff doing a walk-through to tag your junk is more effective at scaring the bejeebus out of you to pay than actually collecting your TV or Beenie Baby collection and selling it for $20 at auction to cover the debt.

Do you have any high-end items in your house? Any motorcycles/RVs/Rembrandts? What state are you in?

PS. Ballys is well known for their draconian collection activities. I will NEVER have a Ballys membership because of this. There are so many horror stories out there.

Thank You guys for all your support :wink: , rstimson I'm in New York City, My Ex-husband has a Furniture Store and I have really nice expensive furniture and electronics, For these people to come in and remove my stuff not to mention my personal belongings, but I went to court today so hopefully everything will be okey in Gods willing. Can't wait to write a report on Ballys and Asset Acceptance too :evil: .

To the guest that stated, "then don't buy gym things," the cat is already out of the bag and that comment sounds somewhat insensitive. Consumers are not responsible for the unfair business practices that a company chooses to engage in. Anymore I suspect that so many of these businesses like Bally are just in it to get your money no matter what. If other people have been having trouble with this company I can only suspect that they are running scams on people when former customers t try to cancel their memberships, and still months even yrs. later when the consumer thought the acct was canceled, they come back claiming that you owe them money.
