Hello

Background
About 3 years ago I was involved in a bad business deal. Being naive and a friend of my now ex partner I put myself in a ridiculous position that i'm quite ashamed of. Because of that I'm around 16k in debt in credit cards and about 10k in debt on a prosper loan. I've gotten to the point i've had to stop paying my cards as the combined monthly payments became too much. I'm still paying my prosper loan and 2 cards but the rest have gotten into collections. It's a blight on my life as in the past I've been extremely responsible.

Current
Yesterday I received a Notice to Appear from the GA Magistrate Court from Portfolio Recovery Associates. Again I had (yes I'm not sure how I got so irresponsible) ignored the original statement of claim.

Today I found this amazing site and I'm hoping I can at least get to the point I can negotiate with the creditors again without going through a wage garnishment. I've read a few threads and will continue to read all day. So for I see I might be able to motion for discovery and ask for a bill of particulars to stall and be able to negotiate with them.

Is this correct? I really want to finally take some responsibility and get these debts taken care of the best I can. I don't have too much available cash on hand to pay off big amounts but I have saved about 2k and have plans to increase my savings more to help pay off settlements if possible.

I thank you all ahead of time for any help you can provide!

Hello SoapLady! Thank you so much for the reply.

So do I go ahead and call Portfolio to try to settle or wait to court? If I wait till court how do I bring this up? I've read a ton of post already but haven't found one that matches my situation yet.

Thanks

I would suggest calling them to see if they would settle. Once you go to court they will tack on attorney fees/court costs to your balance. It's worth a phone call.

Thanks Aubrey.

I'll try that soon. Also 1 question.
I have my credit card bills go to my family home do to me moving around lately (jobs..). But I currently reside in a different county for the last 2 years.and am even registered to vote in the county I live in. Can I report this to the court and possibly get it so at least I have some extra time to negotiate?
