Hi Reba--
First thing's first--hopefully you have documentation that this debt was already paid in full. If so, I would recommend a few things, depending on just how in-depth youre looking to go here.
First, you could simply send these people(the collection agency) a certified letter telling them that this debt was already paid in full, include a copy of the receipt proving this, and tell them to get bent--never to contact you again or you will sue them for their fdcpa violations and for trying to illegally collect on a debt thats already been paid in full.
Or, you could do a little homework and really hit these people where they should be hit. If thats what you prefer, then I would call the original creditor--arrowhead--and ask them to verify with you that this debt is indeed paid in full. Once they verify this, ask them to explain to you why they would then send this to this collector. Its entirely possible that this is simply a paperwork error, but I would make sure if it were me.
Once you have Arrowhead admitting that this debt was paid in full, ask them to send you a letter with the account number on it, ststing that you paid it in full. They should have no problem doing this.
OK, now, at that point you will have 100% proof it is paid off in full. If they tell you that they did not send this to the collection agency, then I would take everything and call the attorney general's office in your state--file a formal complaint against this "Tina" and her company. If they DID send it in error, then sending this paid in full notice should stop the problem. If that doesnt, then call arrowhead back and demand that they pull back from the collection agency, or you will sue them for harassment.
As for this collector, there are numerous FDCPA violations....
--refusing to identify the company or provide contact information(address)
--using dishonest claims to try to collect a debt(claiming she isnt from a collection agency)
--overshadowing--federal law requires them to give you 30 days from initial contact to dispute the debt in writing, and she tried to force you to pay before 8 am the next day or she threatened to take legal action--this is illegal.
--using deceptive means in an attempt to collect a debt, when she called your hubby's work and claimed to be a friend of his
--trying to force YOU to pay a debt that your name never was attached to--the only time they would have any legal ability to go after you for his debt is if you live in a community property state, and even then they would have to take you to court over it, since your name is not on the debt at all.
All of those things are illegal according to the FDCPA, a federal law. Your state also may have lawsin place that they could have broken.
