Has anyone dealt with them? I received a call from a Tina Watkins stating she was calling on behalf of Arrowhead Investments and that she wanted to settle what I still owe to them over the phone with a credit card. She told me that if I didn't pay by 8am today that she was going to proceed with the wage assignment and that I would have to also pay the court costs and any legal fees and she also talked about a 510-not sure what this is? Now this pdl is out in husbands name. She told me all this after asking if I was his wife and for my name-she was being very insistent that I pay this-I told her that she would have to talk to my husband and then she asked if there was another number he could be reached at-I told her no and took her number. After I hung up with her my husband called and told me he had also spoken with Tina Watkins before I spoke with her-MY husband asked for the address to verify who they were and she stated that they were not a collection agency and that she didn't have to give him the info. After all this she called my husband's place of employment and stated that she was a friend of my husband to try and get a contact number for him. Would this be considered a violation? And the phone number she gave-888-622-0222-seems to belong to Phoenix debt management? Should I send a DV letter them? Oh and she told my husband that they sent a letter out to us on April 15th-well we never saw this letter? Any advice would be greatly appreciated. By the way, we have already paid Arrowhead Investments back what we borrowed.

Hi Reba--

First thing's first--hopefully you have documentation that this debt was already paid in full. If so, I would recommend a few things, depending on just how in-depth youre looking to go here.

First, you could simply send these people(the collection agency) a certified letter telling them that this debt was already paid in full, include a copy of the receipt proving this, and tell them to get bent--never to contact you again or you will sue them for their fdcpa violations and for trying to illegally collect on a debt thats already been paid in full.

Or, you could do a little homework and really hit these people where they should be hit. If thats what you prefer, then I would call the original creditor--arrowhead--and ask them to verify with you that this debt is indeed paid in full. Once they verify this, ask them to explain to you why they would then send this to this collector. Its entirely possible that this is simply a paperwork error, but I would make sure if it were me.

Once you have Arrowhead admitting that this debt was paid in full, ask them to send you a letter with the account number on it, ststing that you paid it in full. They should have no problem doing this.

OK, now, at that point you will have 100% proof it is paid off in full. If they tell you that they did not send this to the collection agency, then I would take everything and call the attorney general's office in your state--file a formal complaint against this "Tina" and her company. If they DID send it in error, then sending this paid in full notice should stop the problem. If that doesnt, then call arrowhead back and demand that they pull back from the collection agency, or you will sue them for harassment.

As for this collector, there are numerous FDCPA violations....

--refusing to identify the company or provide contact information(address)

--using dishonest claims to try to collect a debt(claiming she isnt from a collection agency)

--overshadowing--federal law requires them to give you 30 days from initial contact to dispute the debt in writing, and she tried to force you to pay before 8 am the next day or she threatened to take legal action--this is illegal.

--using deceptive means in an attempt to collect a debt, when she called your hubby's work and claimed to be a friend of his

--trying to force YOU to pay a debt that your name never was attached to--the only time they would have any legal ability to go after you for his debt is if you live in a community property state, and even then they would have to take you to court over it, since your name is not on the debt at all.

All of those things are illegal according to the FDCPA, a federal law. Your state also may have lawsin place that they could have broken.

The name of the company is Phoenix debt management. I laughed my A$$ off after reading their website "Our highly trained associates possess a combined twenty-five years experience in the collection industry and strictly adhere to all Fair Debt Collection Practices Act guidelines."

That is another phone number they use from what I have researched. Everything I have read about them goes against the fdcpa which they do have to abide by. If I find anything else,I will post it.

what they don't note in there website is that they have 250 employees.
