Collection agencies & OLD debts
Date: Fri, 03/19/2010 - 17:41
I get random calls and letters occasionally on OLD debts (meaning older than 8-10 years in some cases, that is past the SOL in my state----some of this was indeed owed at the time and there is and was no money to pay. Some of it is Not owed, and some of it is just tacked-on charges.
I normally ignore these fools. I do not talk to them, I do not admit to them even the few that I do actually have a debt. Like others, these have been sold and resold so many times I've lost track and keep dumping the paperwork in a big box LOL.
NEVER have I received a single legal document, summons, or registered letter. Even back when it was a "collectible" debt (meaning before the statute of limitations expired).
So my question is (as many others would like to know)
HOW DO I GET THIS CRAP TO STOP!?
C&D and DV are fine and dandy but they simply do not work. ESPECIALLY once the debt is resold. I do not want to waste my remaining years and money on sending registered letters and such, and there is ZERO money for hiring an attorney. Additionally, filing complaints with the govt agencies isn't doing any good, as they are flat-out overwhelmed with this stuff, and nothing happens. My information/investigation is that overall, very few fines are levied, and they cost the companies so much less than they are collecting overall, so they don't change their business "practices". They look at this as "cost of doing business" It's sad. And contacting BBB is a real waste of your time! lol. State attorneys general are also overwhelmed---there isn't enough staff in the world to be able to truly handle all the consumer issues that are hitting these days.
So....... IS there a way to actually get it over to these people there is ZERO chance they will ever see a penny from me? In addition to the real issue: many-years-past collectibility; There is NO income, NO property even if they COULD still sue, or the law changed to allow it to somehow be collectible after all that time. So there is nothing here. And won't be, unless I somehow win a lotto (not gonna happen).
I have noticed a distinct LULL in the calls/letters in the last year (assuming due to changes in legislation). I realize their entire business is directed into trying to drive a person crazy enough to pay them something, no matter how much or how little, whether they owe or not, just to get them to leave a person the hell alone. Yes, I understand it's their job lol, but personally, I'd rot in hell before I would work for a company that does this.
But it is so frustrating and aggravating that this continues and there must be some way to get this waste of their time and mine stopped.
Or is there?
Thanks for any real answers!

Stick the letter in a 8x11 envelope, write on the envelope you dispute the debt, fill the envelope with as much heavy stuff as you can & send it C.O.D. ;) Or, just keep them in a file. There's no law that says you have to acknowledge any of those letters. ONE of these days, you'll probably get a Summon's & then, if you have the letters, you'll be able to see how many times it's been sold.

Unfortunately the only way to get them to stop is to write a C&D but they will just sell it and the next CA will start it all up again. Your only recourse is to just ignore them.
You could check and see if any are reporting on your credit reports...if they are then they have been re-aged and you can send a DV letter. If they ignore you then you can sue them.

No, nothing has been placed on the credit reports, and the original debt and original "write-offs" (where applicable) have dropped off some time ago. The reports are "clean" and have been for over 2 years.
So I guess I just continue to put up with the phone and letters.... sigh.
Thanks for the information!

Change your phone number and if mail you receive looks like it may be from a CA, write return to sender. Maybe they will eventually give up if they can't get a hold of you. Just a thought.
