if a collection agency issued a summons & complaint, and the debtor filed an answer and sent letters of validation to both collection agency and orginal debtor, regardless of the time passed from the original summons and complaint, if the debtor received a dismissal without prejudice is the debtor liable to be sued again by another collection agency over the same debt?

thanks.

You know what? Why wait to be sued? Go on the offensive! Get copies of your credit report and find out what all this debt is lasted as. Then write a debt validation letter stating that you are baffled as to why they would bring suit against you and then just as suddenly dismiss it. Also attack the listing on the credit report, and even go so far as to challenge their right to even look at your credit report. You can do all of this and potentially file suit for a good amount. If they sue you before you can sue them, so much the better as you will decimate them in court since they obviously don't have any sort of validating documentation and you can counter sue them for all the violations plus all the costs of court.....

So...why not take it to them?

really.. I had no idea. this stupid thing has been going on for almost 1.5-2 yrs.. some debt collector/atty sued on behalf of the collection agency, and the original creditor wont talk to me since it has been shuffled from agency to agency, then to this atty/debt collector. I had moved 2 times since this whole thing started due to work, and I filed my answer with the court it was originally filed in sent both the collection agency and the atty/debt collector validation letters no replies, then they did a motion for change of venue, which I finally got in the mail and I never heard back.. then got a voluntary dismissal with out prejudice...
who should I address this validation of debt & questioning why you dismissed it? I surely dont want to keep making light of it. haha.. seriously. thanks for your replies.. :)
