So, if we go to court and they have nothing more than this statement that has nothing itemized, I can request a motion to dismiss with or without prej?

It is best to make your request in discovery, that way it is recorded by the court that these documents are to be requested and that the plaintiff has failed to produce said documents. At this point you would motion to dismiss with prejudice. Dismissing with prejudice will keep them from filing another suit.
