Question about SOL- Paul Law Office in Utah

If the statute of limitations is up, form what I have read, this means that they can no longer collect on an account. Does this apply to legal action if it is an attorney's office sending the collection notices? I recieved a letter from Paul Law Office in Utah demanding payment in the amount of almost $5000 for a credit card I got over 10 years ago, my first year in college. The credit line was a mere $500 but at the time I got in over my head and this one fell along the wayside. It has definitely been at least 8 years since a payment was made on it or since any contact was made with me regarding this. Do they have any legal grounds to pursue this and what is the best action for me to take?

They should not attempt to sue you, but they have the right to attempt to collect payment. You have the right to send a cease and desist letter. They have the right to sell the debt...you have the right to repeat the cease and desist letter.

Paul Law Office does not even follow the fair debt collecting laws so it blows my mind how they think they can harrass people when they can not follow their own laws. They are not to verbally threaten you and/or scream at you and one of their employees has done so and continues to do so. A phone was borrowed who this account even was and they continue to harrass the owner of the phone. They have a system that picks up the phone number called from. You also have the right to sue them for harrassment if they continue to threaten or scream and if they continue to contact you verbally after you have sent a cease and desist letter but make sure and send certified.

im suing paul law office as we speak if anyone has been harrassed by them contact a lawyer at the fair debt act they will review your case for free they came after after 10yrs on a old debt and harrasssed the entire family court dockets online show they have been sued many times

They recently called me about a debt that just expired,
according to the SOL of Florida (4) years. The person
was disputing my cease and desist letter for trying to
collect an expired debt, said that it was a written contract
and that it expires after 5 years. I told him he was wrong. He
spoke very fast, like he was nervous. Then he said see you
in district court, then hung up on me. He will wait until
hell freezes over before he gets any money from me.

If the SOL is expired then you have nothing to worry about. That is your affirmative defense. They would not be too inclined to spend money on a lawsuit that they know they will lose. It also sounds like he was violating the cease and desist letter. I do not believe that they are allowed to call you to dispute it. It literally means cease communication. They are allowed to contact you one time to tell you what action they will take. So, if they do not sue you, then they are also in violation the FDCPA for threatening to take action that they did not.

I hope it is not too late but I want to sue them too - they have called and threatened me on more than one occasion.

paul law has called me hundereds of times for years trying to collect a debt that is over 13 yrs old.. i told them the sol was up so they cussed me and insisted it was not.. the next time they called they decided the sol was not up and gve me a date of last payment and somehow they changed the date of last payment to a different year to make it appear as a payment was made.. so they said.. it was not ever paid by me or anyone else ..they did not even know who the original creditor was or what it was for..They said see you in court as they were filing in civil court I told them good luck the 10 yrs has come and gone yrs ago...wv sticks to it.. still to this day after i have told them everytime do not call me they still call..

I guess you're pointing at 're-aging' of a derogatory account. If they change the date of 'last activity' they're violating the Fair Credit Reporting Act. You may certainly file a lawsuit against them. Such legal suits are looked upon as 'willful violation' under this law.

We just received a letter in the mail today from them also. We have been stationed in Germany 5 yrs now so I now this debt is older than 5 years, whoever the Orinal Creditor: Checkmate is. They stated in this letter they are giving my husband 30 days to reply, not going to happen with him in Afghanistan and limited phone access. After reading all the responses here, I know honestly feel and think this is something seriously bogus.
