Do I have to pay off my spouse debt after she has died?

I lost my wife a few months ago. We had a few joint credit card accounts and a few separate ones. Am I responsible for paying off both the types of credit cards? Creditors are calling me for payments.



You are responsible to pay off the debt of the joint credit card accounts.

You are 'Not' responsible for your spouse's debts in the account where your name is not attached.

You are responsible for your wife's credit card debts if you:

  • co-signed the credit card agreement

  • live in a community property state

  • are the deceased person's spouse and state law requires you to pay a particular type of debt, like some health care expenses

  • were legally responsible for resolving the estate and didn't comply with certain state probate laws.
