If someone plans to file bankrupsy and they want to have a debt discharged that they owe to a friend, and they have nothing in writing like a note, what do they need to do this?

I ask because a person that owes me a large sum of money, I believe is planning on filing bankrupsy, and lately they are pressing to set up a promissary note between us for the amount they owe me. They want to suppy the promissary note.

How do I protect myself?

Thanks

Ms Crystal

I think they have to have in writing who all they owe to included in the bankruptcy. If they don't then it may not be discharged. I am NOT vertain of this, but think that is the case. I wouldnt give it up.
