My debt was sold to a collection agency. I found out throuhg a certified letter court summons. Can this be resolved without going to court? I sent them a letter trying to reach a reduce payment plan; i have not recieved a response from the agency. However, i have recieved another court summons. They want to resolve this through the courts. The amount is for less than $3000. Why through court? What are my options?

Why are you assuming the debt was sold? Many debts are worked 3rd party or are assigned to collection agencies or law firms.

Who do you owe? Who is collected? Who is the plantiff on the summons?

They are not going to negotiate thru the mail....you need to call and negotiate. Right now you need to answer the summons though...

They probably will not accept a payment plan in lieu of a judgment.

Yes, you need to answer the summons properly first. You can go through the following page to know how to deal with the summons:

Next, consult an attorney. The lawyer can help you draft the reply correctly and deal with the case efficiently. The lawyer may also help you reach a settlement out of court.
