Have you validated this debt Reny? I wouldn't pay ANYthing until they validate this debt. I wonder if you send them a proposal offer for payments and maybe offer a much lower payment than you can afford, then perhaps if they counter offer your payment will be what you can afford??? I honestly have no clue if that idea is even possible so don't take my word on it, perhaps someone else can give you good advice on how to deal with this. Also, make sure you get this agreement in writing or I would tell them NO DEAL. If it isn't in writing then I think they can sue you, if it is in writing I don't think they can sue you as long as you are making the payments on time. Definitely send money orders, you don't want them getting a hold of your checking account number. I was just tossing around some ideas about payment offers but I'm really not sure about that. :?

Even though a collection agency has your debt, alot of times the bank will still let you come into a branch a make the payments on the overdrawn account. I had an overdrawn account before with a bank, and they closed it and sent it to a collection agency. I called the bank and they were still able to locate my account even though it was charged off. They let me come into the branch and make the payments. If you don't mind me asking, what bank are you dealing with?

If you are paying on the full amount due and sending in $200 or more per month then I think it is probably unlikely that they would sue even though they might threaten it and even if it is slightly less than what they are requesting.

Although it is not impossible I just don't see them suing over $1638 especially if you are making close to the amount of payment they asked for. You might consider trying to get an agreement to pay in 9 months instead of 6 months. It would probably take 3 months at least to take you to court and act on a judgment. They might get more per month at that point if they can garnish your wages but after taking into account their lost time they would end up getting the same deal overall so what is the point meaning they will be paid off in roughly 5-9 months regardless of which path they choose unless you quit paying completely.
