debt and getting married

I have a lot of debt and judgments. I would like to go ahead and marry my sons father. If we get married and keep everything in his name, checking account house and cars, etc., can my creditors take him to court to make him pay for my debts. I do not work, I am a stay at home mom.


That's good to know. He knows about some of my debt like my repoed car when I got pregnant and others but he does not know about all of them. I afraid to get married because right he owns our home and checking and both vehicles are in his name. he is okay with this. I just don't think we could afford to have his paycheck garnished. He should be punished for my mistakes. When I do go back to work when our son gets older I plan to personally file bankruptcy if possible.

it doesn't matter when you decide to file for bankruptcy...your husband is in no way, shape, or form responsible for your debts prior to the marriage...even in a community property state, he would not be responsible for any of your debt prior to the marriage.

But watch out! If your name is on the checking account, that account can be attached...you would have to go through the hassle of proving that all the money in the account is derived from him solely. Why bother with that hassle? if you need to be on the accounts, be on as an authorized user not a joint.
