Help Please on how to deal with Pinion

I had a couple of payday loans, for reasons not discussed they ended up with Pinnion. I worked with them and have paid off one. Now the second one’s payment plan should be underway they were going to take 2 payments, but because of something that happened personally I can't commit to that. I can make much smaller payments now.
I was going to pay say 200 bucks on the 15th and another on the 31st. this would pay off the debt completely. However, I can't pay anything this time as I will not have any money to live from and I may be able to pay 50 bucks or so on the 31st of Aug.
However I know they will not wait that long. The person I have been working with has been patient and we seem to communicate well, and even talk about the weather and how things are going. Anyway I am really concerned that they are going to send this to my county DA for fraud, they have told me that they will have to send it down town or to the other side? They said I can be and will be arrested most likely at work. Nooooo... can’t have that happen this could take place as soon as this coming week. Help me please I’m in the Northern California.

First of all,take a deep breath and calm down,you've come to the right place :D Why would they arrest you for fraud?They can't just say if you don't pay I am going to have you arrested.Did you give the a check that was post dated?If they have been working with you,I would go down there,if you can, and explain everything to them and see what can be worked out.Sometimes if they can tell you want to pay this and are not trying to duck it,they will work with you.If they arrest you,they sure wouldn't get their money,and to go through the legal process would cost them. I've never heard of them being able to 'arrest' you, and especially going to your job and doing it. sounds like a scare tactic to me. But i think Bossy is right. go in, if you can, and sit down and explain it to them. maybe they can work something out with you. sometimes throwing yourself at their mercy, helps. Take the honest approach. I don't have much experience with payday loans, but I think I know enough to know that they can't just arrest you. on what grounds? fraud? what fraud?? and telling you that it will probably happen at your job, is just a scare tactic, because they know you'll be embarrassed and don't want that to happen. I'm not saying, ignore them, they're full of crap because I wouldn't want you to sit back and push the envelope and find out it was for real. Plus, here in this forum we will never tell you to 'run' from paying someone money that you know you owe. so again, with what Bossy said, go to them and explain it all...maybe they can help you. keep us posted! =) shirley

The most that can happen is they can file a civil suit against you and obtain a judgement..You seem to have a good track record with this company, as long as you communicate and keep your end of the bargain, there really is no reason for them to sue you..It's a waste of money for them, anyway.
I don't know if you have other types of debt as well, but consolidation can also be an option here.

Thank you for the reply's it was an internet payday loan. They are going through Pinnion to get their money. I only had two; one is paid off via payments via Pinnion. The other I have not started to pay yet as I was supposed to pay my first payment this last Thursday or Friday. I left a very long voicemail for the person that was handling the case. I just don????????t have the money right now or at least what they would like.
The original voicemail to me sounded like this person was fearful or afraid for me. Because we have a decent or good report or at least I assumed we did, this person's supervisor is not going to be happy and will send the case to the other side to be sent directly to my county DA. They said the DA will decide and see that this is check fraud, which is why I am really scared. Even though in my voicemail I offered a payment structure that I can live with, as I did on the first loan.

Don't be afraid. As everyone has stated above you will not be arrested nor will the account be forwarded to the DA. This is a common collection scare tactic. They think if they threaten people, they will pay them immediately. Stay strong and let them know that you know the laws and your rights.
