Phillips and Cohen called my home Saturday, Monday came along and they called my office. I have a call center, and one of my employees answered the phone and let him know I was not in the office but he may be able to contact me at home. After this was said, the the guy tells her that I should be at work if this is my company, she went on to say, I just work here sir and I am sorry but I can not help you with my bosses personal stuff. This guy went on started yelling at her saying we were being sued and that he wanted her name because she and who ever else worked for me was being sued the whole company was being sued. I almost forgot, before he started yelling at her, he asked for her name, she stated she did not have to give him any information. What are my rights? what should I do? I am in the process of getting my loans adjusted and possiblby filing a chapter 13, I just want to stall them for now so they do not rush to take me to court, get a judgement and be able to seize my accounts. The amout is high, so it would be worth them taking it to court in case somebody is wondering. I just want to know, do I call them? I know you dont tell them much because they do not listen anyway. I just want to see how some of you people would handle this, or have handled this situation.

I almost forgot, one last thing, my phone system at the call center has a button to press for recording, so here is what I told my office. If they call again tell them to hold, click the button and the phone system tells them "YOU ARE BEING RECORDED" then ask them, can I help you. I just wanted to add this.

This was an Advanta business card, I am also incorporated. What I am doing is just looking to stall them from going to court too fast, I have a friend that does loans, he is working with an attorney as of today, I had to send them a ton of stuff early this am, on this new program that he said I may be a good candidate for, what it does is gets my motgages at a fixed rate, eliminates any seconds, and your payment comes way down being off they go off of what the properties are currently worth. Now I am not behind on any mortgages, my business just took a big hit with this economy, so my credit card dept had to be the first not to get paid. So what I was thinking was, try and get on this program with my properties and in the mean time this same attorney is also a BK attorney, so I file BK and just fight through the 5 years and start fresh after the discharger. I know you just asked if this was a business card, but I want it to be clear at what I am trying to do. This is a very difficult time and these decisions are tough. I jsut heard about this new program through a friend, so we are just getting the ball rolling.
