phoenix debt leaving a message threating with processing

So I am sitting at work, waiting for the day to end. My wife calls up and asks me to check her cell for messages and there is a message from Mr. Carter threating me with processing me if I don't call him back. I looked up the phone number through this site and find out it's phoenix debt management. Most likely they bought up the debt for one of our old IPDLs. Seeing what other people had written on here, this is what I've decided to do. I sent this email to [email]info@phoenixdm.com[/email].

To whom it may concern:My wife and I recieved a phone call from your company threating us with processing? (whatever that is supposed to be) against us in St. Albans, VT. The message was from a Mr. Carter. I am assuming this is about an internet payday loan debt. I would like to know what company this is for and how you plan on collecting on an Ilegally made loan (PDLs are illegal in the state of VT). I have paid the principle of this loan and then some via monthly rollover fees (which are also illegal in VT). I would like your street address so I know where to Send my debt validation letter and my Cease and Desist letter (attached at the bottom of this page is the C & D letter). I will only be accepting communication through e-mail or by USPS. I am also sending this e-mail to the banking division of VT as well as making complaints through the Better Business Bureau and the Federal Trade Commission. Through research I see that your company supposedly follows the Fair Debt Collection Practices Act. One of the standards of that act is you are supposed to send a letter through the USPS regarding the loan before taking any action. You have obviously ignored this by Processing me in St. Albans, VT.

Hopefully they will take the point from this email as well as the C&D letter I sent. I accidentally sent this email 5 times (hit the send button a few too many times :D ). Anybody have any suggestions as to how else to deal with them?

nice reply,i would also send a letter stating all calls will be recorded,and any voicemails kept.this is a bottomfeeder that collects ipdls.they have no legal recourse not being licensed at all.i like the sending 5 times nice touch. :lol:

So now PDM has called my wife 3 times at work (right in a row) directly violating the C&D letter. They also left another message on the cell phone saying that they going to initiate action (yeah right). I've sent complaints to the attorney generals office and the VT division of banking, as well as resent the cease and desist letter several times. Any other suggestions?

just have your wife and her co-workers keep record of the calls.record yours at home.other than that you are doing fine.

I know I'm late on this one, but I can't resist.

I would have asked what kind of "processing?" Food Processing? Film Development Processing?

Oh no! Not the dreaded "DOWNLOAD!"

Call them back while recording the call sounding all concerned asking what they mean by "initiate action." Make sure to check if your state is a one-party or two-party consent state when it comes to recording calls.

I always love those ominous phone calls with the scary sounding, yet completely empty, threats. I would have called him back, recording the phone call, acting all concerned and scared and seeing if you could catch him in any fdcpa violations. I'm pretty sure you probably would have.

Who knows, they might have paid your debt off for you, after you sued for FDCPA violations. If they keep violating the C&D letter, I would definitely sue them.
