I need to check on this company. I have been hospitalized for a smashed tibia and fibula. Things have been crazy and one of my bills made it to this collection agency. I told them I could start paying them in three weeks. Then I had a woman call me and tell me I didn't take make this agreement. I then thought it was a different company and new I couldn't make another payment of the same size and told her I could pay a smaller amount. Then she told me I had already made an agreement of the original amount. I then realized she was lying to me. They also want the routing number for my checking account with my agreement so they can put it through on that date. Well I don't trust them. Should I??

I will be reporting this to the attorney general and to the FTC. She violated many portions of the FDCPA and frankly I am very annoyed that they are making this very difficult to resolve.
As for calls, they can not call a cell phone, knowing it is a cell phone without your permission first. So if you receive calls and it is your cell phone simply tell them and let them know it is not to be used if they have an automatic dialer. Also, requesting a Cease and Desist on the account will stop all mail and phone calls from that collection agency unless a new account goes into their office which they can then contact you on until another Cease and Desist is demanded. This is better in writing through certified mail to have it documented that they received the letter. That works for the validation of the debt too.
You never have to give them any bank account or credit card information and if you do they can only use it on the dates intended for the correct amounts. And let it be known that the collection agent cannot give false information... that is yet another violation.
Good luck!
