1. On my credit report they are reporting this as date opened 9/2009 with experian. Can they do that?
2. The account is now with a company called Enhanced Recovery Corporation and they are reporting to experian with the date opened 9/2010.
I tried numerous times to call Pinnacle but they only have a generic voicemail and never callback. I did call Enhanced Recovery and ask them to validate the debt and was told by them that this account was for a tmobile account and is owned by tmobile and they do not have to validate the debt. They say its my burden to prove the debt. I said so I pull my credit report and notice your company is reporting this debt that i dont recognize and your telling me you do not have to show me any proof that i owe this debt? They said yes to that? Appearantly this is an account from 2006 that is being sent to various C.A. and they are reporting this as opened in 2009 and the other reported open 2010 is this legal? What is my recourse if not?

Opened just means when the CA got the account. Oh and since they are listed on your credit report they HAVE to validate..the key thing is the demand must be in writing, technically they can tell you they won't validate over the phone..but saying they don't have to after receiving a letter is a different story.
You should look up 1-2 punch. It is a form of debt validation. Basically you send a letter CMRR and demand validation or removal of said account. IF they are collecting for TMobil ( and I doubt it since it is almost 5 years old) they should have no problem providing validation. Once you get the green card (or email notification if e file) you then dispute with the reporting agencies. If the CA verifies the debt to the CRAs, then they have violated and you have them.
Have you had a Tmobil account? If so, does what they say you owe match what you remember oweing? I have heard a lot of complaints that some people never had any such account or that it had been paid off....so I would not take anything the CA says, make them prove it.
Likely Pinnacle had the debt at one time but looks like they don't have it now. Do the same thing with them....send a DV letter CMRR and when you get confirmation they received it, then dispute with the CRAs.
Thanks for the advise i will do that. What exactly can I do if
Thanks for the advise i will do that. What exactly can I do if they reply to the cra after I sent the validation letter? I did have a Tmobile account but that was way back in 2005 I believe. I am a valued metro pcs user you just cant beat it. Thay claim I owe 400 dollars and quite honestly i've never had a cell bill over 80 bucks so there is no way thats possible.

Alrighty then definitely send the DV as stated above....dang..this listing should only remain on your reports for about another year or so. You specifically need them to prove how they calculated over 300 bucks in interest and/or fees and THEN they need to provide a signed agreement/contract that states how much interest that can accrue. That is the ONLY way a CA can charge interest, if it states it in the contract or they get a judgment.
