Yup, it too late.
Who is the credit card? And who is the attorney? Who is the plantiff in the case? If it is the credit card company, they still own the debt and the attorney is suing on their behalf.
Capitol One. They sold the debt to a credit collection attorney
Capitol One. They sold the debt to a credit collection attorney. They say the plaintiff is Capitol One, but Capitol One told me they no longer own the debt. The debt collector is Hunt & Henriques.
If capitol one is the plantiff, the debt is assigned, not sold.

I would double check with Capital One. I had the same issue about 1 1/2 years ago. the summons said Cap 1 was suing, but in contacting Cap 1 they said the had sold off the account previous year and did not know who had it now. They sent me a letter saying they did NOT sue me nor ask H&E to represent them. Took it to court and the case was thrown out with prejudice and the judge went off on the lawyers for it. It seems it was NOT the first time these "lawyers" have done this. They issue it as Cap 1 suing and it is NOT Cap 1 them suing, its that firm with NO records to legally sue. Make sure who owns that debt first
