HELP! DV letter requests

Is this too much to ask from a CA in the form of debt validation?
I don't expect to recieve anything from them but at least I can show the court that I tried, right?

The summons, delivered to me on January 2, 2009, was the first notification given to me from .... So I am writing to request that you provide validation for this debt. Please provide me with the folling information:

- A copy of the original card holder agreement with the original creditor signed by me and any other documents wich form a basis for this complaint.

- Any documents which state and prove that the amount owed allegedly on (date), is in fact the amount owed to original creditor by me on that date.

- Copies of any documents wich prove transfer of ownership of this account including the transaction amount for which ownership took place and the date for which transfer of ownership occured from assignor to (CA)

If the plaintiff can provide me with proper documentation, thought U.S. mail service and before the summons date of (date), proving that the alleged debt does in fact belong to me then I am certain that this matter can be handled out of court.


Ok, first a DV won't be of any use to you since you have already been served. What you need to do is send them interrogatories, during the discovery phase, asking for those documents. You should also counter sue for what is called 'overshadowing'..basically this company did not give you the chance to dispute that they are by law required to do, that is a violation.
