Company/Individual reported: Portfolio Recovery, others won't tell me

All of a sudden late last year, I started getting phone calls looking for a (example) Cynthia. I 'had' several credit cards over 8 years ago just in case of an emergency. I canceled them out, never using them (I think I would remember if I did). I've been disabled and on Social Security for 16 years now. I received two copies of my credit report a long time ago which I called the Credit Card companies to notify them of fraudulent activity, someone used my name for credit and have my name as owning businesses. Which I contacted each credit card company and straightened out. That was over 7-8 years ago and at the time, I was homeless and living in a tent and on a friends couch! I’ve moved 6 times since then and a friend took me in because I can only afford to pay $200.oo for rent! (I can’t get any other assistance except Food Stamps - due to standing up to our State Senator, of course there’s no justice and lies prevail, so I lost.
At first I was telling ‘everyone’, politely, they had the wrong person because they were asking for someone that had my first name and old name and since I straightened things out with everyone and I know I don’t owe anyone anything, it couldn’t possible be me.
Portfolio Recovery must have called everyone with my old last name until they reached my mother, that lives in another State and gave them my number and new last name! Now everyone that used to call with my old last name are using my new last name!
Portfolio Recovery along with other people, start calling me and their machines 8 am - sometimes 9 pm Mon-Sun. Most will only give me 'their' name but not their company and I won't say who "I" am or admit they are talking to me. One man kept using my name... "Cynthia, just admit Cynthia that you are Cynthia and I'll answer you Cynthia." He talked this way with 'every' sentence.
I tell (who ever) DO NOT call this number before 10 am or after 4 pm, or on Sat or GOD'S day (Sunday) but they do. Due to one of my disabilities, (PTSD) I have panic attacks (I tell them but they'll just wait until I'm done or listen to my T.V), I freeze up and literally can't hang up or have to pick up the receiver and hang it up immediately (I've actually did this to people I know). I see a Psychologist to help me through some calls I've had.
I asked one guy "Where are you calling from?" Meaning the company/business and he gave me a City and State, refusing to give me the company/business name until I told them who I was.
I have been blamed for so many things in my life that others did (family also doing this to me) so I'm actually 'scared' that someone is blaming me for something else.
I received a letter from one place saying I owed over $17,000.oo.... That's twice what I get in a year! So someone did something... I can't do confrontations due to having sever attacks, some have actually gotten to heart attack mode and had to have EMT's and others help me get breathing and calm.
So my questions are:
1. Do I 'have to' tell them they 'are' talking to me or ‘tell’ them my name when they refuse to tell me the company/business they are calling from?
2. When they’re told the hours and days to call, can they ignore it?
3. How many times a day can they call? Even if they get my machine, I answer or answer and hang up? Even after telling them they have the wrong person?
4. How many times a week can they call?
5. I’ve heard a silent ‘beep’ in the back ground while talking to a man and when I asked what the beeping was, he told me he was recording our call! Can they record you and not tell you?
6. I hooked up a tape recorder and have recorded some calls. One was just this past Sunday in which I told “Sue”: “Do you know the time is 5:19 p.m. and that the date is February 15th, which is Sunday?” “Sue” said she knows the date and time and it being Sunday. My caller I.D. shows she was from Portfolio Recovery which I have already recorded telling them “NEVER” to call on Sunday that it is “GOD’S day!” What good is recording them? What do I do with it?

I copied the “Script” I found on this site to make it easier for me told ‘talk’ to these people, Portfolio Recovery, Bank Services, and others I have no clue who they are because only a phone number shows on my caller I.D. and when I Google the numbers, it doesn’t always tell me.
Everyday I’m in extreme pain and when they call when I am, I lash out because I can’t deal with the pain ‘and’ them.
Someone please help me with these answers because I can’t take much more of having to bite my tongue.


First off if you are on disability and social security, they can't take your money anyway. If they sue you they can ask you to pay but all you do is say NO!!!!!!!! NO!!!!!!!!!! NO!!!!!!!!!!!!!!!!

Sorry but I have to emphasize that. Bottom feeding collectors try to take advantage of people on exempt income and it makes me sick when they know they can't touch it.

If you have money in they bank, they can't touch that either, just tell them it is from social security. If you have assets such as a car or home that is not exempt, they can however take that.

OK now that we got that out of the way, what state do you live in? When was the last time you think a payment was made???

I am just trying to get a rough idea of how old these debts are. If they are passed the statute of limitations then they can't sue you and if they do then you can sue them. They can try to collect by phone or mail until the world ends but if you send a cease and desist letter then they can't...if they do, SUE THEM!!!

Hey, have you thought about contacting your local district attorney's office to get help? If you let them know that you suspect that someone stole your identity, they might either be able to help you, or put you in contact with someone that can. If someone did in fact run up bills in your name without your permission you can go after them. There has to be something that can be done about this. This really angers me to no end. They can't take your social security. My in laws are on social security and they owed some money to a hospital. The hospital tried to sue them and the judge threw it out and said absolutely not!! They set up a payment plan of $10 a month.......eventually the hospital just wrote it off. Now they don't owe a dime. Now they are on Medicare or Medicaid so thank God they can now go to the doctor...You just keep fighting this. They can not win!!!! We are all here to help you. I am new to this site, but I am trying to help the best way I can. I am knowledgeable in everything but Payday loans, which is the stupid trap I fell in. I definately know how you feel!!!!!
