Two years ago I rented an apartment. Four months later I had to break the lease. I thought that I had paid the final months rent as I was contracted to do in the lease. A few weeks after I thought I was dont with them, they sent me a "final bill". They sent the bill via email and gave me 10 days to dispute before they sent it to collections. After I had not responded to the bill, they filed a claim with the company who I had a deposit with, Sure Deposit. Sure Deposit paid the claim. After the claim was paid the management company filed a claim with the collection agency as well. A few months later Sure Depsoit filed a claim with the same collection agency but for about 50 dollars more.

In my humble opinion the only company that I may be liable to here is Sure Deposit. The apartment management company should be happy that they got their money. Do I have any legal recourse here? What do you all think??

Thanks for answering ditchdebt. I have since been in contact with the company who bonded me for the security deposit. Im gonna try to get an invoice or statement of payment from them to prove my case to the CA and the credit bureau's. I am, however, in debt to Sure Deposit cause they did what they signed on for. If the CA does not take account for the apartment complex off my report, I will take them, the management company, and all 3 credit bureaus to court. I'll get a grand outta somebody!!!!

When it comes to credit reporting, both the apartment complex and Sure Bond are entitled to report so their will be no suing of either of these or the credit bureau for the debt. Generally when you break a lease, there penalties that have to be paid or additional months rent if a tenant is not found quick enough.

Thanks for answering Soaplady. I broke the lease in accordance with their terms. As far as I knew I paid everything that I was supposed to pay. They decided that I didnt. They charged me more, probably because they could. The bond that I had covered that. Therefore the management company has been paid. What if I would've left a cash deposit? I was covered for $500.00. If I would've left a cash deposit they probably would've taken the whole $500.00. Are you saying that the management company deserves to get paid twice? I dont think so. I accept the fact that Im in debt to the bond company and I will pay that. The management company has been paid in full and they should remove that account from my report.
