Have u been also making payments to JCPenny?? Has that been credited to this acct also?
A lot of times CA's do waht's called skip tracing and that's how they found ur parents info! Send them a cease and desist letter and that will stop the calls to ur parents and to u.

You should do what Ang said and also send a validation letter to the CA. Also you should check and see what happened to the payment you made directly to Pennys. I would also call Pennys and ask them, don't -ever- trust what a CA tells you, since they are trying to collect on it they very likely will not give you viable information.
Thanks for the info!
I had scheduled a payment to be made, but then they called my parents AGAIN before it was actually made. So I called and they had me cancel it and that's when I set up the payment arrangements. They must have pulled up my original credit card application from about 15 years ago to get my parents info. They also had me working at my husband's employer where I have never been employed! So I should be able to pay JCP directly even though it was charged off? I haven't tried to make any more payments directly to JCP since I set up the arrangements with RR. Does anyone know where to send them a cease and desist letter?

If the acct is charged off then u will have to pay the CA and send a debt validation letter along with cease and desist letter to the CA, Redline.

How old is this debt? I also had skip tracing done on me by BB&T. They actually contacted my aunt and uncle! They contacted them daily for about a week and continuously left messages on their answering machine. I know it was because they did not have a good phone number on file for me, but I was very surprised that they didn't contact my siblings or parents, as opposed to my aunt and uncle!

Before you pay them a single red cent I would send them the DV letter and be sure to include the partial cease & desist..heck, I would point out that they now know dang well where you are and further calls to your relatives is in violation of your rights.
But definately make them validate the debt, besides you need them to send you the original contract if they are calculating any interest, because the only way they can legally do that is if it states so in the original contract.
If they do validate it, then you send them payments you can afford. Ignore them bleating that they have to have this much or that much...send the payments money order and make copies of these money orders. Even if they do get pissy and try to take you to court, you can show the judge that you are making good faith in taking responsibility for the debt.

In the C&D letter, should I just ask them to "stop contacting anyone other than myself regarding the account"?
Thanks to everyone for their help!

Hi. In the C&D letter you can ask that they contact you and only you, and you can let them know that you will only accept correspondence in writing via usps. This is a good way to have it set up because it allows you to have copies of all documentation received.

Yes, the only permissible reason for them to contact anyone other then yourself is to find out where you are and how to contact you. They have already done this, so write them and explain that no further contact will be made to anyone other then yourself, to call anyone else is in violation of your rights. Here is a basic example:
You can add that into your debt validation letter. There have been some sample debt validation letters floating around here for you to use.

Ok, I now have a new question. I was just going through my bank account and I see that the electronic checks that I authorized are for exactly $7 more than our agreement amount. When I go to their pay by check website, I see that they charge $7 to do a check transaction. I was never told that there would be an additional charge. Can I stop payment on the next check and inform them that I will be sending all future payments to their address? Even though during our phone conversations I tried to get a mailing address to send payment to and I was told that they do not accept payment that way. I really hate RR!!!
Hmm...
If you had paid via "check by phone" and they had not disclosed the fee to you at that point, then you never agreed to it and should be entitled to a refund, or at the very least credit the $7.00 fee to your debt. I believe that companies are required to disclose financial transaction fees because it requires a written, verbal, or implied agreement where the consumer is required to make an informed decision to accept or deny said fee. At least that's the way it's done in banking.
