I received a letter from a local attorney offering to file bankruptcy for me in reference to a debt for $1100. This is how I found out about this debt!

I called the court clerk locally and gave them the docket number and they said I was being sued by Palisades Collections LLC on behalf of HSBC credit card. I had an HSBC card a few years back and quit paying on it.

What happens now? A process server has to serve me and then I go to court? Then what? What will they do to me in court? I am just a housewife I have no income other than my husband??

Thanks.

Show up to court. If you don't the judge with award the creditor a default judgment. Be sure you show up there with a budget showing that your were broke and doing the best you could . Even if they obtain a judgment all that means is that you owe the debt and the court says to pay them. You can work out a payment arrangement usually or even settlement for a reduced amount in a lump sum. I hope this helps :D

How old the loan is? You need to find what the statue of limitation in your state. If that has already passed out (ref:I had an HSBC card a few years back and quit paying on it. ), it'll act as a defense in your case.

Be present at the court on the day, otherwise, the creditor will get a judgement against you, as Mobile has mentioned.
